Policy analysis: Frank calls Scalia a 'homophobe'

Policy Analysis is a weekly column that uses contemporary news to examine a particular legal issue.  Its purpose is to provide the electorate with a fresh way of looking at legal issues as well as the reasoning that policymakers use in making your laws and judges use in interpreting them.


 

Recently, Barney Frank referred to Justice Antonin Scalia as a "homophobe."  Presumptively, Frank has reached this conclusion as a result of Scalia's reluctance to allow heightened scrutiny Equal Protection claims on the basis of sexual orientation and his failure to acknowledge marriage as anything but but a union between one man and one woman. Dismissing one's reasoning as bigotry is a popular tactic of late, and Frank's comment is a classic example.

Advocates of homosexual rights, specifically gay marriage, point to the right to individual liberty owed to all citizens of the United States. The broad justification overlooks the importance of the traditional nuclear family. The liberal mindset allows for the destruction of the nuclear family without remorse.

The reasoning is impracticable and dangerous to the fiber of our society.To maintain consistency and credibility, liberals should embrace polygamy. If the right to marry someone of the same sex is protected, the right to marry more than one person should not be left unprotected as they are both based on the same principle. The contradiction exposes the absurdity of liberal thinking and evidences the liberal acknowledgment of such absurdity. Liberals seem to immediately grasp the dangers of childhood development that polygamy presents only to blind themselves to the hindrances of having two fathers or two mothers.

Mainstream conservatives consistently condemn gay marriage rights as well as the right to practice polygamy with the primary justification for each being the destruction of the traditional nuclear family resulting in the breakdown of the fiber of society.
 

The contemporary attitude in the media is that the conservative party is comprised of  elitists without compassion. This untruth has been perpetuated by unsubstantiated liberal propaganda. However, it becomes increasingly apparent that liberals lack compassion for those who deserve it. There is no larger example of twisted principles than this: Foregoing the rights of an unborn child, while vigorously defending the rights of a murderer not to be subjected to the death penalty. In this instance, liberals portray conservatives as heartless and lacking compassion when it comes to the issue of gay marriage and adoption.  But, liberals use this tactic to shift the focus away from the conservative compassion for children and the importance of the nuclear family.
 

The marriage of the radical left and the media has clouded Americans ability to recognize these inconsistencies.  The avoidance of contradiction is vital to maintaining grounds for public support. As more citizens begin to recognize the conflicts in reasoning put forth by liberals on social issues, the pendulum of public opinion will gain momentum back toward the conservative ideology.
