You remember--the story where the government arrested the part Savage submitted in a caliber conversion project? The one where they attached chains, duct tape and plastic ties to induce firing of more than one round? And then called it a machine gun and seized it?

The basis for the Claim is straightforward:
Claimant objects to defendant property being referred to as a “machine gun,” because it does not fit the definition of a machine gun in the United States Code and the Code of Federal Regulations.
The details of the Answer, specifically as stated in the Third Defense, demonstrate the Machiavellian way ATF deals with citizens they view as enemies:
The BATF attempted to coerce the Claimant’s president into resubmitting defendant property as a machine gun, which would have subjected Claimant’s president to a charge of perjury and/or providing false statement to a government agency, violations of 18 USC § 1001. The actions of the BATF constitute attempted duress and coercion and attempted entrapment of the Claimant’s president so as to prosecute him for perjury and/or false statement.
Nice. You need to resubmit the part classified the way we tell you to, which makes your first submission a prosecutable offense.

"Pro-Gun Pick" pledges gun legislation
I note some observers in the gun rights community feel my fears of a Kirsten Gillibrand turnaround on guns are overstated. I'd like to share with you, and them, more details of a developing picture:
"I'm going to write the legislation and offer it in the Senate," Gillibrand promised. "I will be a fighter to make sure to keep those illegal guns off the street."
She said she will meet with NYPD Commissioner Raymond Kelly and, that bugaboo for gun nuts everywhere, Mayor Bloomberg. She already sounded like Bloomberg as she noted that many Southern states have much laxer gun laws than ours.
"All these guns are coming from other states," she said. "We have to target these traffickers."
What--she's going to introduce a bill to make "illegal gun trafficking" even more illegal? What could she possibly be proposing that's not already on the books?
Stay tuned on this one. I have a feeling gun owners who enthusiastically supported her are about to get Gillibranded.

Montana bill under attack
Guess who questions the statement:
[T]he right of Montanans to defend their lives and liberties...and their right to keep or bear arms in defense of their homes, persons, and property...is fundamental and may not be called into question...
The Montana Sheriffs and Peace Officers Association and the Montana County Attorneys Association have attacked MSSA's HB 228, about self defense with firearms, with two hit pieces now being circulated to legislators...
In other words, "The Only Ones."
