On Monday at 4:15 p.m. a hearing will be held regarding the release of photos from Photobucket.com that shows Casey Anthony partying.
Anthony’s attorney, Jose Baez, and her defense team are attempting to challenge their release stating the prosecution is attempting to harass and embarrass their client. The motion also includes a photo of the Casey Anthony flag doll that was recently for sale on eBay.
In addition, the defense filed a second motion to block the release of the jailhouse videotape taken of Anthony the day she was told a child’s remains were found near the Anthony home.
Baez claims the Photobucket images were created a prior to Caylee’s disappearance and are irrelevant to the murder case. Baez’s office said, “If they were to be disseminated, they will only sensationalize the life of a young woman and may be used to attempt to paint her in a negative light.”
The defense team is also arguing that when the jail videotaped Anthony, they violated her Sixth Amendment right to have her attorney present, as well as her medical privacy rights.
Anthony is charged with the first-degree murder of her 2-year-old daughter, Caylee Anthony. Her trial is expected to begin sometime in the fall of 2009.
