Arizona Gov. Brewer throws a fit about UN Human Rights Report

A US State Department report to the United Nations on human rights contained a reference to Arizona's recent controversial illegal immigrant law and Arizona Governor Jan Brewer is protesting it.  The State Department listed its opposition to the Arizona law as an example of upholding human rights in the US.

On Friday, Brewer demanded, in a letter to Secretary of State, Hillary Clinton that the reference to Arizona and it's new law be removed from the report.  The report is part of a UN review of human rights in which all member nations submit progress reports every four years. 

Brewer wrote, “The idea of our own American government submitting the duly enacted laws of a state of the United States to ‘review’ by the United Nations is internationalism run amok and unconstitutional.”

Governor Brewer is misguided, first off, the law itself may be an unconstitutional example of Arizona overstepping its rights by racially profiling citizens when enforcing federal immigration laws. On July 28 of this year a federal judge in Phoenix issued a temporary injunction blocking implementation of much of the law.  US District Judge Susan Bolton blocked the section of the law that required local and state law enforcement officials to check the immigration status of those they suspected were illegal immigrants.

Also, it's just a report and an accurate one.  The federal government did step in to protect human rights.  The rights of all the citizens of Arizona not to be harassed based on their ethnicity.  There is a big problem with illegal immigration in the US, but pulling someone over for speeding and then, only because they look Hispanic, demanding that they prove their citizenship is harassment and unconstitutional.

    Um, if you had read the LAW YOU ARE TALKING ABOUT you would know anyone with a valid driver's license would not have had their citizenship questioned.
    And hey, if I'M driving, And the cops stop me, and my license is not on me, I'd expect some difficulty.

  • The law as it was written did give the police the right to check your status even if you had a license. In fact it said that they were obligated to to "determine a person's immigration status if there is reasonable suspicion that the person is an illegal alien." What if someone has an out of state license and the cop can't verify it on his computer, so he arrests them and hands them over to federal authorities to determine their citizenship?

After seven years of litigation, a federal judge ruled in October 2008 that Sheriff Arpaio and county health officials “violated the Constitution by depriving jail inmates of adequate medical screening and care, feeding them unhealthy food and housing them in unsanitary conditions.” As of the ruling, Maricopa County had paid “up to $43 million, according to local news media, as a result of lawsuits alleging deaths, injury, mistreatment and other claims in the jails” during Arpaio’s time as sheriff. Arpaio is also in open conflict and dealing with active lawsuits with most of the city governments and police forces within the county (for violating jurisdictions and interfering with city-based law enforcement, as well as creating significant public safety hazards during his immigration raids and/or when trying to serve warrants with the help of SWAT teams) and with his own county commissioners (for abuse of power and gross mismanagement of funds). A U.S. Department of Labor Investigation concluded that Sheriff Arpaio failed to pay $2 million of overtime pay to his employees. The Phoenix New Times reported, “Since August, 2009, the Department of Labor had been investigating whether Arpaio was illegally, and systematically, refusing to compensate detention officers for overtime. It appears that was, in fact, the case: Thanks to Labor's intervention, the county will be forced to make good with a total of 1,900 detention officers. They'll receive back pay for the work in their next paycheck, Smith said.” Arpaio’s department actually has a pretty terrible record on doing what it’s actually supposed to do: responding to calls, enforcing laws, investigating crimes, and ensuring public safety in the unincorporated areas of Maricopa County (city police departments have jurisdiction in most of the populated areas of the county), and transporting prisoners and serving warrants throughout the Maricopa county. Mayor Phil Gordon says that Arpaio have created a sanctuary county for felons stating: “ Arpaio have 40,000 felony warrants stacked on his desk. Why not go after the real criminals and actively serve outstanding arrest warrants, which local agencies see as a county obligation and responsibility?” Arpaio regularly uses smear campaigns, intimidation, baseless investigations, and even unwarranted arrests to harass, intimidate, and retaliate against his critics and political opponents, and he has lost numerous lawsuits on this count as well (all, again, at taxpayer expense). The website of Phoenix TV station KPHO reported: ”The FBI is looking into accusations that Maricopa County Sheriff Joe Arpaio is using his position to settle political vendettas.” In March 2009, the Arizona Republic reported that “The U.S. Justice Department has launched a civil-rights investigation of the Maricopa County Sheriff's Office after months of mounting complaints that deputies are discriminating in their enforcement of federal immigration laws.” The official complaints which brought about the investigation, “said Arpaio had exceeded the limits of a federal program that gives local police federal immigration-enforcement powers by ordering deputies to ‘scour’ Latino neighborhoods looking for illegal immigrants based on skin color.” Arpaio is suspected of misspending $50M in Taxpayer funds, after Arpaio refused to turn over financial documents to Maricopa County supervisors or attend a county board meeting on concerns over his budget, the board voted to freeze some of his funds until it could investigate his misspending. According to the Arizona Republic: “The board wants the records to help set Arpaio's budget but also believes he may be misspending or misusing public funds, though to what extent is uncertain. Officials suggested there are ‘substantial problems’ with transactions from at least one fund that may need to be paid back.” Some feared Arpaio had overspent up to $50 million. Meanwhile Arpaio was denied budget also in view of pending indictments from the U.S. Justice Department and the FBI investigations.

    This comment is completely accurate. Read Judge Bolton's opinion Examiner; you would know that Judge Bolton struck down the bill only because she felt the federal government occupies the entire area of immigration. In other words, federal law preempts SB 1070. By the way, the US Supreme Court has held that race CAN be considered when determining whether reasonable suspicion exists. The biased news media damages Arizona's reputation, not SB 1070.

    This is one of the most ignorant statements I have heard. My son is a police officer. He is half Hispanic. There are many many officers that are Hispanic in the state of Arizona, or have relatives that are Hispanic. If you have ever been to the state of Arizona you would see a large population of ours is HISPANIC.

    Ignorance is not bliss and your article is proof that anyone can get a job with a newspaper.

  • You are misunderstanding my point. I know that a large part of the population is Hispanic. I live in Chicago, where there is also a large Hispanic population. The law as it was written allowed police to "determine a person's immigration status if there is reasonable suspicion that the person is an illegal alien." What is the suspicion based on, as it's written, it is so general and wide open to interpretation, that police could use ethnicity to discriminate.

    This is all a political move by the Democrats...They cry racial pofiling every chance they get..NO matter where you go in the US if you are speeding, run a stop sign etc. you are pulled over and asked for your Identification, vehicle registration, proof of Insurance, if you don't have it you have so many days to gather that information to take down to the Police Department to get verified..This is the way it is done here and many other placed across the United States...NEVER has this been considered racial profiling untill the Democrats polls are threatened...Hillary has NOW lost any chance at any elected office in my point of view...GO BREWER

    2, HOW MANY NEW POLICEMEN / WOMEN SHES HIRED TO HOLD AND PROCESS THE HUNDREDS OF THOUSANDS OF UNDOCUMENTED IMMIGRANTS? NONE.

    Who’s behind these laws?

    The Immigration Reform Law Institute, or IRLI, the legal arm of the Federation for American Immigration Reform, or FAIR, drafted the Arizona law and most of the copycat bills. The Southern Poverty Law Center designated FAIR a hate group because of its founder’s writings, its repeated participation with white nationalist groups, and its receipt of major funding from a racist organization.

    Copycat laws frequently rely on the work of attorney Kris Kobach, who works for IRLI. Kobach’s lawyering has cost localities who have hired him millions of dollars while the laws have been found unconstitutional. The Arizona law was brought forth by State Senator Russell Pearce, who the Arizona press has described as having a history of associating with neo-Nazis and sending anti-Semitic emails.

    there's plenty of facts (MR. ALL CAPS :-( ) on both sides. It's interesting that over 90% of Arizonans are for Gov Brewer. And, no, no, no, no, no racial profiling was allowed by her law...simply enforcing the current federal law. If the police can only check I.D. of all, all, all those who were stopped for a violation (that is not a lot of people...that's a mere pittance) then the actual number of illegals discovered would be very small. The civil rights of the illegals are being violated...they die by terrible ways due to our ignoring this problem...they are not better off because our federal government ignores this issue. Spin politics goes both ways, especially when the MSM sells the masses on the Democrats side...those who read and don't rely on the MSM can find facts without your telling them how we can't afford to send the illegals back or we can't afford to protect our borders....which is good for illegals and American citizens both. You're big on "can't" and pointing fingers...not big on what's good for, solutions for protecting the innocent on both sides of the border...not to mention that terrorists and "whoever" can slip in the Arizona border easily.

    Eight million Undocumented immigrants pay Social Security, Medicare and income taxes. Denying public services to people who pay their taxes is an affront to America’s bedrock belief in fairness. But many “pull-up-the-drawbridge” politicians want to do just that when it comes to Undocumented immigrants.

    The fact that Undocumented immigrants pay taxes at all will come as news to many Americans. A stunning two thirds of Undocumented immigrants pay Medicare, Social Security and personal income taxes.

    Yet, nativists like Congressman Tom Tancredo, R-Colo., have popularized the notion that illegal aliens are a colossal drain on the nation’s hospitals, schools and welfare programs — consuming services that they don’t pay for.

    In reality, the 1996 welfare reform bill disqualified Undocumented immigrants from nearly all means tested government programs including food stamps, housing assistance, Medicaid and Medicare-funded hospitalization.

    The only services that illegals can still get are emergency medical care and K-12 education. Nevertheless, Tancredo and his ilk pushed a bill through the House criminalizing all aid to illegal aliens — even private acts of charity by priests, nurses and social workers.

    Potentially, any soup kitchen that offers so much as a free lunch to an illegal could face up to five years in prison and seizure of assets. The Senate bill that recently collapsed would have tempered these draconian measures against private aid.

    But no one — Democrat or Republican — seems to oppose the idea of withholding public services. Earlier this year, Congress passed a law that requires everyone who gets Medicaid — the government-funded health care program for the poor — to offer proof of U.S. citizenship so we can avoid “theft of these benefits by illegal aliens,” as Rep. Charlie Norwood, R-Ga., puts it. But, immigrants aren’t flocking to the United States to mooch off the government.

    According to a study by the Urban Institute, the 1996 welfare reform effort dramatically reduced the use of welfare by undocumented immigrant households, exactly as intended. And another vital thing happened in 1996: the Internal Revenue Service began issuing identification numbers to enable illegal immigrants who don’t have Social Security numbers to file taxes.

    One might have imagined that those fearing deportation or confronting the prospect of paying for their safety net through their own meager wages would take a pass on the IRS’ scheme. Not so. Close to 8 million of the 12 million or so illegal aliens in the country today file personal income taxes using these numbers, contributing billions to federal coffers.

    No doubt they hope that this will one day help them acquire legal status — a plaintive expression of their desire to play by the rules and come out of the shadows. What’s more, aliens who are not self-employed have Social Security and Medicare taxes automatically withheld from their paychecks.

    Since undocumented workers have only fake numbers, they’ll never be able to collect the benefits these taxes are meant to pay for. Last year, the revenues from these fake numbers — that the Social Security administration stashes in the “earnings suspense file” — added up to 10 percent of the Social Security surplus.

    The file is growing, on average, by more than $50 billion a year. Beyond federal taxes, all illegals automatically pay state sales taxes that contribute toward the upkeep of public facilities such as roads that they use, and property taxes through their rent that contribute toward the schooling of their children.

    The non-partisan National Research Council found that when the taxes paid by the children of low-skilled immigrant families — most of whom are illegal — are factored in, they contribute on average $80,000 more to federal coffers than they consume. Yes, many illegal migrants impose a strain on border communities on whose doorstep they first arrive, broke and unemployed.

    To solve this problem equitably, these communities ought to receive the surplus taxes that federal government collects from immigrants. But the real reason border communities are strained is the lack of a guest worker program.

    Such a program would match willing workers with willing employers in advance so that they wouldn’t be stuck for long periods where they disembark while searching for jobs. The cost of undocumented aliens is an issue that immigrant bashers have created to whip up indignation against people they don’t want here in the first place.

    With the Senate having just returned from yet another vacation and promising to revisit the stalled immigration bill, politicians ought to set the record straight: Illegals are not milking the government. If anything, it is the other way around.

    Obama and his administration just can't seem to do enough to show their distate with Gov. Jan Brewer and Arizona. If they worked just as hard at improving the job situation and economy of this nation, we'd probably be in pretty good shape by now.
    This whole ObamaNation is about getting-even, showing everyone who has an "idea" that doesn't agree with Obama's that 'he's the boss'! Thank God, there are only 29 months left of this Obama vindictiveness and BS.

The website of Phoenix TV station KPHO reported: ”The FBI is looking into accusations that Maricopa County Sheriff Joe Arpaio is using his position to settle political vendettas.” In March 2009, the Arizona Republic reported that “The U.S. Justice Department has launched a civil-rights investigation of the Maricopa County Sheriff's Office after months of mounting complaints that deputies are discriminating in their enforcement of federal immigration laws.” The official complaints which brought about the investigation, “said Arpaio had exceeded the limits of a federal program that gives local police federal immigration-enforcement powers by ordering deputies to ‘scour’ Latino neighborhoods looking for illegal immigrants based on skin color.” Arpaio is suspected of misspending $50M in Taxpayer funds, after Arpaio refused to turn over financial documents to Maricopa County supervisors or attend a county board meeting on concerns over his budget, the board voted to freeze some of his funds until it could investigate his misspending. According to the Arizona Republic: “The board wants the records to help set Arpaio's budget but also believes he may be misspending or misusing public funds, though to what extent is uncertain. Officials suggested there are ‘substantial problems’ with transactions from at least one fund that may need to be paid back.” Some feared Arpaio had overspent up to $50 million. Meanwhile Arpaio was denied budget also in view of pending indictments from the U.S. Justice Department and the FBI investigations.

I agree we need highly skilled legal immigrants and not the surge we have had in the last ten years of semi-skilled and manual cheap labor. The later are the ones bankrupting this nation.     Whatever has become of our country, when the federal government sues the state of Arizona. But this time allowing illegal aliens back on Main Street without arresting them. The Obama administration is looking for any excuse to go after Arizona, because they dared to criticize their Immigration Czars. The Justice Department have become like Big Brother in George Orwells' "1984".Let's remember them all in November. The Tea Party, the Independents and the moderate Conservatives. want these Liberals out of power? Every bloody incumbent, every politicians catering to the illegal alien invasion. Now we have the Administration going whimpering to the United Nations, saying that Arizona is violating human rights? We need desperately a compact federal government, not the monolith that is bleeding THE PEOPLE'S America dry, to give public entitlement to illegal aliens that is costing the US taxpayer billions. THESE PEOPLE BROKE OUR LAWS AND MUST BE DEPORTED.

  • Jan Brewer for VP in 2012? If she keeps her name in the headlines much longer, she could be a contender. I haven't decided who I want for President yet. It won't be Jan, though. She's proven herself to be a bit too controversial for that to happen.
