In a stunning display of latent disrespect for President Barack Obama and a complete disregard for the good order and discipline of the U.S. Armed Forces, the Army has recommended "birther", 1LT Scott Easterling for promotion. In February of this year, the Tennessee native joined forces with "birther" attorney Orly Taitz and wrote a widely-reported letter calling President Obama a "usurper" and "impostor" because he did not believe the President was a natural-born citizen. At the time, many believed that 1LT Easterling had jeopardized his career and possibly his freedom for violating the Uniform Code of Military Justice (UCMJ) which clearly prohibits publicly insulting the integrity of the President of the United States; instead he got an "administrative reprimand", also known as a slap on the wrist.
Here are excerpts from the Army's response to a Freedom of Information Act (FOIA) request submitted on September 23, 2009. The information below was provided by Major Brian J. Chapuran, Staff Judge Advocate for the 3rd Sustainment Command (Expeditionary) based at Fort Knox, Kentucky.
"Our investigation concluded that 1LT Easterling wrote the letter. 1LT
Easterling never refuted that conclusion.1LT Easterling received an administrative reprimand for violation of the
UCMJ.1LT Easterling is currently assigned to Headquarters and Headquarters
Company, 3d Sustainment Command (Expeditionary) in the Support Operations
Division.After this incident and subsequent investigation and action, 1LT
Easterling was not involved in any other incidents. As a result, his
supervisors recommended him for promotion on his officer evaluation report."
Barely a month after a historic election elevated the first African-American to the highest office in the land; 1LT Easterling had the audacity to call it all a sham without a shred of credible evidence. I'm left wondering, "How many times does a commissioned officer in the United States Army have to publicly question the integrity of the President before he or she would be denied a promotion and receive more than a stern "talking to" for their actions"?
The actions of "birther" officers who are abusing their oath of office is not only detrimental to the morale and discipline of our troops, it provides aid and comfort to our enemies abroad. I'm not sure what's worse, the actions of 1LT Easterling or those of the officers who recommended him for a promotion.

The wordings of the current oath for commissioned officers are as follows:

(DA Form 71, 1 August 1959, for officers.)
Officers are only loyal to the US Constitution.

Assuming Sen. Obama, was born in Hawaii, to one USA citizen parent, then he would never need to worry about nationality, as he is a USA citizen born to at least one citizen on USA soil. No contest, I agree with FactCheck, he is a USA citizen.
HOWEVER, since both parents were not US citizens, as the records show, as FactCheck admits, and he has stated so, then he fails to qualify as a USA Natural Born Citizen.
Clearly, FactCheck in their statement admits Sen. Obama, was born to one British citizen parent. Therefore, how can anyone logically conclude Sen. Obama, is more than a USA citizen? Sen. Obama, qualifies for and can run for any public office, with the exception of POTUS. Sen. Obama, is equal in civil rights to, but less eligible for POTUS than, a USA NBC.
Immigrants are aliens who carry a passport and obey the laws. Illegal aliens don't have a passport, and don't obey the laws. Aliens do not have a birth right of USA citizenship.
An alien is not subject to the Jurisdiction of the USA, as they are traveling under a passport, except both an illegal alien and an alien under passport, have not relinquished bonds to their homeland, nor established allegiance to the USA, and the citizenship of the mother transfers to the minor child. Aliens can run to or call on their consulates or Embassy, for help, since they owe allegiance to and are subject to the jurisdiction of laws and treaties, of their homeland, not the USA. A child born to an alien mother, with no known USA citizen father, on USA soil, really should not be a USA citizen, since the parent is subject to foreign jurisdiction, and has not established allegiance to the USA.
Where do you idiots with this British Nationality Act crap come from? Okay, you can surrender your sovereignty to Britain, but the rest of us won't. A child born in this country is not subject to whatever laws are observed in his father's native country. As a matter of fact, neither is the foreign born father. Once he crosses the border he must observe American law.
There are only 2 classes of citizens in this country: Natural Born and Naturalized. Obama, obviously, didn't naturalize. Birthers pay attention. Those are the only 2 types of citizens in this country. You can either be one or the other. There is no such citizenship class known as Native Born that is distinct from Natural Born. US Natural Born Citizen qualification is not defined in any law, the Constitution is the only legal document written with reference to it. So everything you just wrote is utter BS.
The fact of the matter is that Legal precident is on Obama's side, the fact that the State of Hi has certified his birth according to their internal records only makes his case stronger.
There is also the fact that only the Senate can impeach and remove a president, so even if a judge was bribed by wealthy Birthers, it would do nothing to his ability to hold office under all laws of the US, a judge has no authority to even bring the case.
Now as for the officer in question, he should be thankful that Obama is the kind of Commander and chief not to hold a grudge, if he was it would be well within his rights as the supream commander of the armed forced to have Captain Scott Easterling locked up in the brig for the duration of the war.

It is a shame that some believe that just because one of your parents isn't a citizen of the country a person was born, that the same person in not citizen. Natural born doesn't retract the requirements for person born as citizens, but expands it. It allow person who are born outside of American with two parents who are American citizens to be a "natural born" citizen. Image being told that just because one or both of your parents isn't a citizen in the country you are born that you are not a citizen. All natural born citizen means is that you are citizen by birth.
The concerns that I have always had with those who try to disprove what has already be proved by using flawed argument if they are competent. The news about the promoting is mixed. However, I hope is as good as a soldier the promotion recommendation suggest.

The US Constitution Natural Born Citizen clause was based on Vattel's Law of Nations. I just read the other day a letter written by Ben Franklin thanking a Frenchman for sending him the book. Franklin said that they were incorporating parts of it in the Constitution.
Definition of a Natural Born Citizen: Born on US soil and both parents are US Citizens. Obama is not a Natural Born Citizen.

There are 3 categories of US Citizens: Natural Born Citizen(born on US soil and both parents US citizens); US citizen (born in US and/or l parent is a US citizen); Naturalized citizen(foreign born).
Obama's father was a British subject, therefore Obama cannot be a Natural Born Citizen and is therfore ineligible to be a US President.
The fact that Congress ignores this does not mean that Obama is an NBC, all it means is that Congress, the courts and the US Supreme Court are not upholding the US Constitution as they took an oath to do. In fact, they are trampling on our Constitution and uninformed or ignorant people are letting them get away with it.
No court has yet to rule on the merits of the lawsuits. They are using technicalities to circumvent ruling on these lawsuits.

Interestingly the Country of Kenya has also certified his birth in Mombassa and has shown the Birth Certificate. Obama has refused to allow the State of Hawaii to show their version.
Actually, the State of Hawaii was called to task because they, at first, said that they could not release the information because of state laws of privacy. However, they were wrong and a Statute was shown to them where they must show certain information.

Lenore served as the chairman and president of the Annenberg Foundation and backed John McCain in the last election. The Annenbergs contributed to Ronald Reagan's 1980 presidential campaign and upon his inauguration, Leonore was named Chief of Protocol, placing her in charge of advising the president, vice president, and Secretary of State on matters relating to diplomatic protocol. What is the definition of natural born citizen? Look it up yourselves and you'll find that a natural born citizen is defined as one born on the soil of two citizens. Simple. Was Obama born on the soil? We don't know. The only person alive who might know is his paternal grandmother, who claims she was present when he was born in Kenya. Obama refuses to release the documents which would refute or confirm this... However, by Obama's own admission, we do know that his father was a Kenyan citizen, subject to British rule, who never intended or attempted to gain U.S. citizenship.
Ergo, Obama is not a natural born citizen. Should this matter? In theory, maybe or maybe not. All depends on who you ask. In practice, however, it is of ultimate importance because it is the law of the land. If you don't like the law, then change it - don't break it.

Most Legal scholars (plus Congress and the Supreme court, by the way) believe that the term Natural Born Citizen in the Constitution was derived from the works of English Justice William Blackstone, which defined the doctrine Jus Soli, or "law of Ground", which means that persons born within Sovereign territory are "Natural Born citizens". Hawaii certified his birth as being in U.S territory. He is, therefore, a natural born citizen.

I personally know couples and women who come here for 2 weeks for the purpose of giving birth on U.S. soil and for no other reason. After the birth they pack up their belongings and the baby and go home. Not only are they not citizens, they're here on temporary visas. Vattel's book Law of Nations was used by our forefathers in creating the Declaration of Independence and the US Constitution. In fact several parts of the book were used by Franklin and Jefferson. They practically wore the book out.
Also, I just read a letter Franklin wrote to Dumas thanking him for the three copies of the book, in 1775.
Further, Senate Resolution 511 introduced and signed by Obama, declaring John McCain eligible to run for President, states that McCain is eligible because he was born on US soil and BOTH his parents are US citizens. Although the hospital where McCain was born turned out to be another hospital, is beside the point. Obama signed a resolution that said BOTH parents being US citizens made McCain eligible for POTUS.

So Obama isn't eligible to be President. McCain turned out to be born in a Panamanian hospital (we learned after the election) so he isn't eligible either. Romney isn't eligible because he was born in Mexico. And Bobby Jindal isn't eligible because his parents were not US citizens when he was born. They became naturalized after Jindal was born.
So we have a crop of candidates and one sitting President ineligible to be President in accordance with the Constitution and I think that since 3 of them are Republicans, that is why Republicans aren't screaming about Obama being ineligible.
It is also a travesty that our courts are using technicalities and treating these lawsuits like a "hot potato," because they are afraid.

There is no law which defines the qualification of Natural Born Citizen. The Constatution is the only legal document to make such a reference and settled law states that Obama is a citizen. More over the law clearly includes people born over seas of forgein soil, Like Mr. McCain who was born in a hospital outside the Panama zone.

Whether he was born in Hawaii, doesn't preclude the fact that the Constitution states that a President must be a natural born citizen or US citizen at the adoption of the Constitution.
They would have simply stated US citizen. The fact that they mentioned Natural Born citizen further exemplifies the fact that it was Vattel's Law of Nations used for the definition.
Further, John A. Bingham defined a Natural Born Citizen again in Congress, in 1866 as follows:
Rep. John A. Bingham commenting on Section 1992 said it means “every human being born within the jurisdiction of the United States of parents not owing allegiance to any foreign sovereignty is, in the language of your Constitution itself, a natural born citizen.” (Cong. Globe, 39th, 1st Sess., 1291 (1866))
Obama's father was a British subject and therefore owed allegiance to a foreign sovereinty.

Jan, Obama never claimed his father was a U.S citizen. This was always known during the nearly three years he ran as a candidate for president. Yet, the electoral college, the house of Representatives, and Vice President Dick Cheney all unanimously confirmed Barack Obama as the next president of the United States. Not a single vote of dissent. How do you reconcile that with your "open minded research?" Were they all wrong? Asleep at the wheel? Uninformed? Or simply uneducated as to what the requirements are to run for president? If you're right, then over 500 seasoned polititians/lawyers, are then... Wrong?

I did some research on that. WND provided it. (the source of that statement). That comes from expenditures paid to Perkins COE, a California law firm, by Obama's election PAC. There's no itemization of what the fees were for. However, by law they cannot be used to defend against personal lawsuits without documented FEC approval, which isn't on the FEC website. WND mentions that, but declined to investigate further, which is odd. Unless they saw no need to substantiate their assertion. Of course, WND covered itself by adding the phrase "may have". And of course, you and many others replaced that with "is conclusively". The true answer is "nobody but the PAC has any idea what the "fees were for, but it's highly improbable it was used to "block his records" from the public.
