Yesterday the National Rifle Association (NRA) filed a lawsuit in the United States District Court for the Northern District of Texas Lubbock Division. James D'Cruz of Lubbock, TX is the plaintiff in this case.
The aim of the lawsuit is simple – to strike down the federal law that requires adults aged 18-21 to buy handguns in private sales. Though one federal law at 18 USC 922(x)(2) allows adults aged 18 to own and carry handguns, another federal law at 18 USC 922(b)(1) forbids these same adults from buying handguns from federally licensed dealers pursuant to a Brady Act gun buyer criminal background check.
If there ever was a law that failed rational basis scrutiny (essentially a judicial giggle test), this would be it. The NRA lawsuit makes sense, and should be a home run.

This will be successful. Why? Because the establishment WANTS 18-20 year olds to have their handgun purchases registered with the federal government. The establishment knows that the political winds are blowing in our direction and they know that WE WILL SUPPORT this supposed "good" advancement. If you go through a government background check, you and your guns are FULLY registered for the fed's evil intents and purposes and for the slightly different intents of local police depending on your state. Just because they don't have the serial # of the gun you just bought doesn't mean a DAMN THING. They can get it faster than you can say "swat teams love to bash in doors." Private sales are the one thing the establishment despises. Registering more private sales is the TRUE motive behind "closing the gunshow loophole." Currently, there is a very fine line between being an "approved compliant citizen" and having paramilitary thugs smashing through your front door and pointing machine guns at your wife and kids. In another subject, if you want to truly reverse the scary trend towards expanding the police state, you must fight FOR the re-legalization of liberty and and END to government's pet "drug war." The sanctity of our homes is routinely violently violated and the populace is brainwashed to feel good about it because some guy might have had a marijuana cigarette (go read about the Missouri atrocity where JBTs murdered family dogs). We are being conditioned to being used to and to further ACCEPT government bashing into people's homes over nothing. We've already had door to door bullying of gun owners ON LISTS when some crime was committed with a certain gun, all over the nation.
I find it telling that NRA has FINALLY gotten off of their duff and supported this suit. The number of legitimate suits that they refuse to help is unbelieveable. The shennanigans of the NRA when it comes to law suits about the 2nd Amendment only go to define their cowardice and self interest to keep the bucks rolling in. Their claims on McDonald and the attempts to scuttle all of the suits that come up, show their real goals.
If they're old enough to die for their country, they're old enough to buy and own a gun through any legal channel.
