"State of emergency declared in North Carolina," the WECT News 6 headline informs us. "Governor Bev Perdue has declared a State of Emergency for North Carolina in anticipation of Hurricane Earl's arrival."
From blogger John Jacob H:
"Upon Governor Beverly Perdue’s declaration of a State Of Emergency on September 1, 2010 Dove Hunters, Concealed Carry Handgun Licensees, Target Shooters and all other gunowners cannot possess, transport or use firearms off their personal property as per N.C. Gen. Stat. § 14-288.7"
Here's what the statute says:
"§ 14?288.7. Transporting dangerous weapon or substance during emergency; possessing off premises; exceptions.
"(a) Except as otherwise provided in this section, it is unlawful for any person to transport or possess off his own premises any dangerous weapon or substance in any area:
"(1) In which a declared state of emergency exists; or
"(2) Within the immediate vicinity of which a riot is occurring.
"(b) This section does not apply to persons exempted from the provisions of G.S. 14?269 with respect to any activities lawfully engaged in while carrying out their duties.
"(c) Any person who violates any provision of this section is guilty of a Class 1 misdemeanor. (1969, c. 869, s. 1; 1993, c. 539, s. 192; 1994, Ex. Sess., c. 24, s. 14(c).)"
Charlotte Gun Rights Examiner Paul Valone alerted us to the dangers of this statute back in June, when he informed us:
"Grass Roots North Carolina* has joined Michael Bateman, Virgil Green, Forrest Minges, Jr., and the Second Amendment Foundation in a lawsuit against the state’s emergency powers gun ban...Plaintiffs are represented by attorney Alan Gura, who won the recent McDonald v. Chicago Second Amendment case and the landmark D.C. v. Heller case preceding it."
And in February, Dave Workman told us of the North Carolina emergency powers gun ban being invoked during a snow storm.
You can view the complaint Valone reported on here.
But time's up for North Carolina gun owners. They can either obey the law, and go defenseless if they have to leave their homes, or just say the hell with stupid, evil anti-defense edicts and take their chances they won't be caught and punished--providing they survive their encounter with the "authorities".
Government, of course, as usual, has things exactly Bizarro-World backwards. It's when the security of a free state is imperiled that the right of the people to keep and bear arms is most necessary.
What an outrageous choice to force a supposedly free human being to make. Especially when we've seen what can happen when unarmed people are caught trying to get to safety by the "only ones" who can "legally" bear arms in an emergency.
As I asked when commenting on that atrocity:
"If you were trying to get to safety with your loved ones and had to make your way through a no man's land populated by looting predators and worse, would you go defenseless?"
Well, would you? Even if you lived in North Carolina?
UPDATE: GRNC Alert: "His name is Earl and your rights are nil"
UPDATE 2: Paul Valone offers some new observations.
UPDATE 3: I see John Pierce also weighed in on this back during the blizzard.

Reversing course?
"Obama Administration Reverses Course, Forbids Sale of 850,000 Antique Rifles," Maxim Lott's latest Fox News column tells us.
I talked about this a couple weeks back, and one of the commentators stated the reason was "the rifles are not actually the property of the South Korean government. The US government lent them to the South Koreans, and they are supposed to be returned to the USA when the South Koreans are done with them."
I sent a request to both the Korean Times reporter who broke the story and to the Civilian Marksmanship Program, requesting clarification. To date there has been no response from either.
Naturally, I'll share whatever response they give--if they give one--here.

Incredible! How can people be that stupid?
Would you be referring to the governor, the press, the voters, or some combination thereof?
What happened to all those states that were passing laws in the wake of Katrina forbidding just such a tyrannical and illegal power-grab? Did NC get stuck in the dark ages?
Once again stupidity reigns supreme and this is just an act of defiance in the face of McDonald versus Chicago. She is not stopping someone from defending their own private property provided they are on it but they have to go unarmed out into a world full of possible chaos. And I say possible because no real state of emergency exists until the danger is actually there. Anticipating it does not constitute a state of emergency. As of her declaration no damage had been done to the state and therefore no emergency exists. The chicken Little with the sky falling in syndome is alive and well in North Carolina. Has anyone given the governor an IQ test lately? Better yet a common sense one would be more revealing.
“The US government lent them to the South Koreans … “. And, the O’Bobblehead government hopes that the Koreans will sink them in the Pacific in lieu of returning them or making them available to US taxpayers who paid for them in the first place.

I thank that's stupid, now the crooks know that they can rob whoever they want as long as their not at home....
Ah, I see my troll is back from hiatus--listen, I know I generally delete you without comment aside from taking the trash out, but I left this one up as evidence and reported it to Examiner.com management with this message:
"This poster recommends assassinating a specific elected politician. This probably falls under the authority of various anti-terror/cyber terror laws. If there is an investigation, you will probably be required to turn over site visit records, and while this particular troll probably masks his IP, they'll probably want whatever info you have anyway."
Now I will resume my policy of just deleting you. Bye!
North Carolina is our southern progressive problem. This is a result of the decades of William Friday's reign as Chancellor of the University system in that state. In reality, it's far worse than just this disarmament law.
Glad we moved to Georgia. She needs to be thrown out of office. There is an NC rep (D) who has voted against gun owner's rights but used his gun to defend himself against someone breaking in.

Reminds me of when Rosie O donnel ambushed Tom Selleck on her show about his guns and then it was pointed out that she had an armed bodyguard. Hypocrits

Any elected official who violates the American Constitution is guilty of treason. Any law enforcement officer who enforces this law is guilty of violating their oath to defend the Constitution. The people need to convene Grand Juries and hold trials of treason to put people like this governor in jail. And, what about the elected officials who voted in this unconstitutional law? They need to be prosecuted too. Its time to stand up to these Progressive, Communists, and take America back!
I feel bad for some of the people of NC. The ones who would have liked to have one of the post-Katrina laws banning such actions by governments in "states of emergency". But as for the ones who feel it necessary to make defensless citizens even more defenseless. You reap what you sow, Pal! The weeping and wailing will now commence. I recall stories of the left wing California folks trying to buy firearms during the Wats riots being incredulous when told that the waiting periods they wanted did in fact apply to them. You just can't fix "stupid".
Although I am from Virginia I am appalled to think my brothers and sisters in North Carolina are subjected to such a capricious and totally indefensable dictate. I suppose this law falls under the auspices of "I would rather be caught with my gun than for a criminal to catch me without it." This chick should stick to selling chickens.
The 850,000 Garands and Carbines that Obama won't let in would be no different than the "Greek Return" and "Danish Return" rifles that CMP currently sells to qualified US citizens. You see a ton of them at Garand Only matches at various CMP shoots, Camp Perry, and of course at Appleseed events. I bought two of them, one for each of my kids after they did quite well at their first Appleseed. Now I actually get to shoot mine when we go to the range :-) I have no doubt at least some of these rifles will show up here as "parts kits" minus their receivers, their history, and their collectors value. And of course, rifles built from those parts will show up at the usual places, alongside brand new ones from Springfield Armory. So just exactly what kind of "problems" do the Obama administration think they are preventing by banning their re-entry to the USA?
Sounds like New Orleans all over again. So who is going to tell the Rapist, Looters, Vandals, Robbers and Car Jackers to leave their weapons home? Will the Governor and the State of North Carolina guarantee to be there to protect you and your family? This is exactly what the Militia is all about. You know the Second Amendment! That's why you and I have the Right to Keep and Bear Arms.
I am from North Carolina, and if the Government things we will bow down to their stupidity, they have another thing coming! We come from a long line of tea dumpers, and aint about to give up our rights because of some idiot that hides in fear when thunder strikes. "Rights to Bear Arms" enough said!
Absolute tryanny! Both Beverly Perdue and Brap O Bomba
Our rights come from God as per the DOI. They do not come from Government. Just what makes Perdue think she can overrule God?
Be sure to leave all your guns at home during the storm, so that you, too, can be protected by the state like these people were:

(Whoa! I'm used to trimming the HTTP off URLs here because Examiner.com would otherwise reject them. Now it not only doesn't reject them, it actually HYPERLINKS them! Way to keep the peanut gallery on their toes, Examiner!)
I lived in Miami in 1992. Hurricane Andrew destroyed the office bldg. where I worked. 4 days after the hurricane passed I got on my bicycle and rode to the bldg. (couldn't get there by car), and found my co-workers standing guard with shotguns... This was needed because it was a technology company. We surely would have lost our computers and such if it became a free-for-all to loot...
this is just crazy! Leave your weapons at home so every criminal can break in your house and still your weapons!
Yea and Santa Claus will be here in December, do you all believe every thing ya read?
Feel free to point out specifics.
This is really a valid reason to boycott a state. I was looking forward to going there to do some fishing in Pamlico sound and try out the local sea food there. Will try some where else, probably Texas, or Mississippi.
Was considering moving my food machine manufacturing buisness in near future to NC. I'm supprised at this attitude toward the U.S. Constitution from North Carolinians. I need people and a state friendly toward citizens rights and of course the free market system; but this sort of ordinace would be detrimental if a civil or national catostriphy occured and people were not able to defend property assets and personal liberty.
Absolutely stupid, that a governor can declare a state of emergency, and prohibit carrying for self-defense
because a breath of wind may hit the state. I thought North Carolina enacted legislation that prohibited the confiscation of weapons during an emergency. If it hasn't, then it needs to, ASAP.
If I were a civilian in North Carolina, I would disregard the governor's "feel-good" edict, and take my chances on CC. There are way more civilians than LEO personnel in the state, and they can't arrest everyone.
what a stupid governor wait tell the bears and others over populate
and kill kids and others then the problem will be on their hands,
and i'll never move there to live. i think they the goverment is makeing
easer for the bad people to come to their state. their police are bad enough with their guns aney way.

I followed your link and didn't see what you're referring to.
Sorry for being thick, but I need these things spelled out for me--when I'm looking for a "pingback" am I looking for what exactly? I saw comments on your site but didn't see anything with my text in it.
