If we can't trust ATF under oath, when can we trust them?

Gun owners who are active in protecting their rights may know of this--a lot of you may not.

The following transcript is from Oct. 1995. The speaker was Thomas Busey, then chief of ATF's National Firearms Act Branch. The subject was the NFRTR, the National Firearms Registry and Transfer Record. It's the official record the government keeps on all National Firearms Act-registered weapons, such as machine guns, short-barreled rifles and shotguns, suppressors, destructive devices and AOWs, or "Any Other Weapons" the agency deems taxable/requiring registration. Here's what Mr. Busey said about it:

Let me say that when we testify in court, we testify that the data base is 100 percent accurate. That's what we testify to, and we will always testify to that. As you probably well know, that may not be 100 percent true.

I've told WarOnGuns readers before about statistician Dr. Fritz Scheuren informing the 10th District Court that "NFRTR is insufficient for criminal proceedings," and his letter to to the House Subcommittee on Commerce, Justice, Science,and Related Agencies Committee on Appropriations about "inaccuracies in the National Firearms Registration and Transfer Record (NFRTR) data system maintained by the Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF)." In that same journal entry, I linked readers to a report showing how convictions based on missing NFRTR records violate due process.

This is fundamental stuff. Think of the implications for fairness, justice, the law...and, of course, individual rights and property, the protection of which is why we authorize government in the first place.

Some of you may have even seen this video--for those who have not, ain't nothin' like seeing and hearing things for yourself. Mr. Busey leads off in this trailer for "The Gang," produced by Jews for the Preservation of Firearms Ownership:

And here is ATF's "damage control" statement:

Mr. Busey's statement that NFA specialists testify that the data base is 100 percent accurate was a misstatement of the facts. I have never testified that the data base is 100 percent accurate nor, to the beat of my knowledge, has any other of the NFA Branch personnel, including Mr. Busey.

See, rephrasing things so specifically leaves pretty wide latitude. And it doesn't address why such a seed was planted...I mean, why the facts were misstated in the first place.

I said at the beginning of this column some of you may have seen some of this information before. Here's something you probably haven't seen:


It's an actual copy of the incident report that resulted from the training session. And here is the official follow-up from the Office of Inspection. I guess if you're inclined to have faith in such things, "Oops, my bad" pretty much covers it.

Gee, I'm glad that settles everything. Aren't you?

Still, I'd feel better if I knew why, if it was a misstatement, Busey felt it necessary to repeat himself:

Like I told you before, we testify in court and, of course, our certifications testify to that, too, when we're not physically there to testify, that we are 100 percent accurate.

Ah well--nothing to see here. Move on.

    Figures don't lie, but liars sure can figure.

    Busey's disciplinary write-up just goes to validate the old adage; "The man who speaks the truth had better have one foot in the stirrup."

    I can see this being a great cost saving scam for government once national health care is in place. People will not go see a doctor or seek medical help when the need it.
    This will also be cost saving as far as Vets go. They will never say that they feel they have PTS and so no disability or treatment will be needed and payed for by government.
    As far as people lying who work in government, yea so what's new. As I have said many times: A government that lies to its people is not a government for the people.
    Bottom line: Being lied to is par for the course and turning health records over to the federal government by the states. Is only going to keep people and not just gun owners away from receiving needed health care treatment. The folks running this country are idiots. People may as well not buy health insurance any longer because if they need a major operation get it and file a BK or make small monthly payments. If whatever people see their doctors is now going to be government information, f a bunch of that.

    During the OJ Simpson investigation, the lead investigator was caught lying under oath about whether or not he had ever used the "N" word.

    After he testified that he had never said the offending word a tape was played for the jury by the defense in which he said the word many times.

    People are angry about the outcome of the OJ murder trial.

    In my view the jury made the correct decision. They had no way of knowing which other testimony made by the lead investigator was perjured - but they did know that he was indeed a liar who was willing to lie on the stand.

    One wonders what would happen in ATF prosecutions if the above tape was shown as rebuttal. And the tape should stand as evidence of prosecutorial misconduct in any case where an ATF witness testified that the database was accurate.

    The "mental health" thing is a travesty. My ex is bipolar, and violent when she's in her "manic" phase. I was not permitted to bring her mental health RECORDS into evidence because the state felt that if they allowed this to happen, people would be afraid to seek help when the needed it, fearing it would be used against them in the future.

    This sort of thing will do the same - people will HIDE their depression (for example) rather than risk losing their 2nd amendment rights.

    In the short run this might keep a "dangerous" person or 2 from getting a gun, in the long run we'll have many more acts of violence perpetrated by seriously ill people who otherwise might have gotten some help.

    The result: The exact opposite of what they SAY they're trying to accomplish - just like nearly every other "gun law" in history.

    Surely they're smart enough to know this, so one must then ponder "why would they still do it?" The answer is simple: They WANT more violence, they WANT more mass-shootings, to give them the excuse they need to ban guns entirely.

    I don't know if you are interested, but I have written an extensive article for my law school's law journal on the National Firearms Registration and Transfer Record (NFRTR). It goes over the history of the NFA, GCA, FOPA...etc, and then goes into all the documentation of its inaccuracies, as well as, legal challenges to it, especially in the context of violations of due process.     DD, mass shootings are done by those on the mind controlling drugs from their doctors in most all cases.
    What we will see is more killings by whacked out people who are not getting the mental, medical health needs they should have by the being afraid to seek out health care with Big Brother watching and recording all of that information. These kinds of killing are more on like one or two people by a whacked out and out of control mind. A spare of the minute crime then that go on the run to feed the criminal justice system. Where the doped up minds on FDA drugs plan out their attacks in detail killing many in disarmament zones.

    I got the same message for document 2. I don't know what you can do about it, but hopefully, you can get it fixed. Maybe it's in a different folder on the drive, or maybe it's been deleted for some reason or another.

    Good luck with getting it going again! Please let me know when you get it fixed. I'd like to read their stuff and see what they have to say .
