Another candidate for office has responded to the Gun Rights Political Questionnaire, Jim Deakin, who is challenging incumbent John McCain. Here are his answers:
1. Do you believe that the Constitution is the supreme law of the land and that the Bill of Rights acknowledges our birthrights?
JD: Yes. The US Constitution says it best. See Text in RED.
Article VI
All debts contracted and engagements entered into, before the adoption of this Constitution, shall be as valid against the United States under this Constitution, as under the Confederation.
This Constitution, and the laws of the United States which shall be made in pursuance thereof; and all treaties made, or which shall be made, under the authority of the United States, shall be the supreme law of the land; and the judges in every state shall be bound thereby, anything in the Constitution or laws of any State to the contrary notwithstanding.
The Senators and Representatives before mentioned, and the members of the several state legislatures, and all executive and judicial officers, both of the United States and of the several states, shall be bound by oath or affirmation, to support this Constitution; but no religious test shall ever be required as a qualification to any office or public trust under the United States.
2. If so, should these rights be proactively protected from infringement by all levels of government, including city, county and state?
JD: Yes. The US Constitution says it best. See Text above in Purple. Rights guaranteed by the US Constitution cannot be usurped by arbitrary rules and laws established by any state or local government.
3. Please give some examples of gun laws you consider constitutional.
JD: Government is required to protect citizens from each other, not from themselves. When the due process of law is followed, it would be constitutional to disallow convicted criminals and unstable persons from possessing arms. It is important that the due process be strictly followed. Our founders were very concerned that innocent people would be tried and convicted. They established our rules to help prevent that injustice. I also believe it should not be a lifetime punishment. Everyone should be allowed to present their case to a judge to return their rights, including the right to self protection.
4. Please give some examples of gun laws you consider unconstitutional.
JD: All of them. The “Creator” gives us our rights. The constitution is a limit placed on the federal government to ensure those rights.
5. Does the right to bear arms include the right for any peaceable citizen to carry them concealed without a permit, as in Vermont?
JD: Yes. I have a CCW permit because that is the law in Arizona. However, I do believe it is an unconstitutional imposition. Great Americans like the members of the Arizona Citizens Defense League (AZCDL) are working hard to get these laws reversed and return to a constitutional understanding.
6. Do you believe that Americans have a right to own, use and carry weapons of military pattern, and will you use the prestige of elected office to publicly promote that right?
JD: Yes. Reading the history of our country the intent of the founders was to allow the citizens to be the Militia and ready to defend the country against all threats, foreign and domestic. National Guard is not the Militia, they are required to leave their “arms” on base, they don’t get to “keep” them.
7. Do you support or oppose registration of weapons? Why?
JD:
a. Yes, I oppose registration of weapons.
b. Several reasons.
i. It is none of the governments business.
ii. It violates the constitution, including the 4th and 5th amendments. Information is property, information about my weapons is my property.
iii. Least importantly, lists are stolen all the time… how many times a month do we hear about another bank/VA/credit card company losing its “personal” information. Even the government lists are not secure, the Chinese hacked into the DOD servers recently.
8. Do you support or oppose licensing requirements to own or carry firearms? Why?
JD:
a. Yes, I oppose licensing requirements.
b. Same as 7.b. above.
9. What specific gun laws will you work to get repealed?
JD: All of them.
10. If elected, will you back your words of support for firearms rights up with consistent actions? How?
JD: Yes. I took an oath to support and defend the constitution. My entire reason for the pursuit of Arizona’s US Senate Seat is to bring our government back to basics, back to the fundamentals of the constitution. Our government, politicians and bureaucrats are out of control with power. I will work with likeminded individuals within and without the walls of congress to pressure the repeal of unconstitutional rules, regulations and laws.

Wow! Here is definitely the MAN to replace that traitor McCain.
I just hope and pray that if he wins, he is not eventually corrupted by the system in DC. He would need to bring his own staff with him and fire all of McCain's hanger-oners.

Virtually all of us on these sites would defend the 2nd etc. without being too specific. A little money now may mean that we can do it with a little gold instead of a lot of lead.

Great article about Jim. I've met him and he's a good guy. I'm a precinct committeeman in Maricopa County. John McCain's campaign called me yesterday and asked for my endorsement. Of course I said no. But not until I spent about fifteen minutes with the guy explaining why "The Maverick" was just a dunce.

He is almost completely right. So refreshing compared to some others. The parts he is wrong about (#3) can always be corrected through education later. I'd bet he is a good guy.
When I saw the photo of Deakins at the top of the article I was struck by how nice it would be for Arizoniacs to have a living, breathing, viable human being rather than McCain to represent them in the Senate.
Mr. Deakin would be a suitable replacement for "McCainiac" . .
I hope when he says "it would be constitutional to disallow convicted criminals . . . from possessing arms," he at least doesn't mean misdemeanors like Lautenberg, and perhaps even non-violent felonies . . . but at any rate, he is much better than the POS in there now.
Thank you to all of you that took time to read my answers and give some feedback. I will not waiver in my belief that the right to keep and bear arms is fundamental to all other rights given by the creator and guaranteed by the US Constitution.

Jim, buddy, please find a better photographer - unfortunately, your public image is very important in this day and age. You'd likely take a much better photo with a relaxed face, with very little smile. A good photog will be able to help you out with that.

We can't find them because they are ignored by the media. There are probably more people right now in the rest of America who know Deakin is running just from this column than there are in Arizona, where the race is taking place. Even WND ignored him.
The problem is that everybody who has the ability to influence public opinion prefers a man they know can be bought, because then it is only a matter of price. A man who cannot be bought and would stand on principle cannot be owned or unduly influenced by these people or lobbyists or special interests. It isn't that they would be ignored, it is that their ambitions for favors would be judged fairly against the public interest and constitutional duty. That just isn't good enough, these people do not want a level (cont)
(cont) playing field, despite their protestations to the contrary. They much prefer one which tilts in their favor with officials who have been paid to assure their goals are met, no matter how the rules be bent.
However, the message such a man brings is dangerous to them, only if it is heard. So they do what they must to silence him if possible, or at least severely restrict his exposure to the electorate who would welcome him.
I will look a little closer at you Jim. Sounds like your my candidate, so far you get my vote. If you don't win please consider running for state senate. You are better than John

The 2nd amendment does NOT grant EVERYONE the right to own guns. Re-read it. Unless EVERY American is in a well-armed militia then your rights as an individual in that militia aren't infringed! Deakin is too holy.. Keeps referring to a "creator" prove there is a creator first.. Enough of imparting "religion" into American politics. Religion & Politics do NOT mix.. Like oil & water! Sorry Deakin is NOT a good choice. He is a Reagan "foot soldier" just like McCain.. Reagan is responsible for suffocating the middle class, he is responsible for empowering Osama bin Laden in the 1980's and therefore Reagan is just as responsible for 9-11 as Bush & Bush & Clinton are!! I met Jim at the tea party today 3/28/10.Seems to be a straight shooter.I hope he can get the word out in time because J Mc & JD are both public blow hards with enough baggage for a world cruise. Good for him to have the integrity to throw his hat in at this crucial time in history. We need uncorrupted fresh gov. to take back OUR COUNTRY!

The big issues in Arizona are border security and illegal immigration. Deakin is clueless on these issues. He's a bad choice for Arizona.
When was the last time we have heard any politician say they will follow the Constitution or even mention it.Deakin is refreshing to say the least.
All gunowners should remember how McCain wanted to shut down gun shows a few years ago.Also,then why does the NRA support McCain ??
The government has gotten too big and we need them out of our personal lives,McCain is Big Government and I hate to say it but J.D Hayworth is among them.
