ATF multiple long gun reporting form sent to FFLs

The anticipated requirement for Federal Firearms Licensees to report multiple sales of certain rifles in four border states has been defined in a July 12 memo signed by Charles Houser, Chief, National Tracing Center, mandating:

You must submit to the Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF) reports of multiple sales or other dispositions whenever, at one time or during any five consecutive business days, you sell or otherwise dispose of two or more semi-automatic rifles capable of accepting a detachable magazine and with a caliber greater than .22 (including .223/5.56 caliber) to an unlicensed person. You are required to report all such sales that occur on or after August 14, 2011. You must continue reporting multiple sales for the rifles subject to this demand letter until we provide written notice to stop.

“The required information must be submitted on ATF Form 3310.12, Report of Multiple Sale or Other Disposition of Certain Rifles, no later than the close of business on the day the multiple sale or other disposition takes place, “ Houser dictates, enclosing a copy of the form.  While the letter indicates copies of the form are available at ATF’s website, at this writing Form 3310.12 is not linked on their Online Firearms Forms page, nor is any evidence of form availability readily apparent.

The National Rifle Association has characterized this requirement as “a blatant effort by the Obama administration and ATF to divert the focus of Congress and the general public from their gross incompetence in the Fast and Furious scandal,” and further stated:

ATF and the Administration lacks the statutory authority to do this and the NRA will file suit as soon as ATF sends the first demand letters.

It would appear that time has come.
