Baltimore County Transgender Bill leaves too much to interpretation

Councilman Tom Quirk sponsored Bill 3-12 “Human Relations”, which was introduced for consideration Tuesday.  The bill adds sexual orientation and gender identity or expression to the list of protected classes already covered by existing anti-discrimination law.  Bill language can be viewed here.

The law covers discrimination in the following five areas:

  • Housing
  • Employment
  • Education
  • Public accommodation
  • Financing

However, no further definition or parameters are included in the bill language that would define possible ramifications of the law in these five areas.  It’s wide open and presents an infinite number of possibilities.

Does the Public Accommodations requirement in the bill mean we have to build restrooms for men considering themselves men, men considering themselves women, women considering themselves women, women considering themselves men, and “other”?  What would that cost taxpayers?

If not, then it has to mean that a man who claims he considers himself a woman would have lawful access to women’s restrooms and locker rooms.  That poses serious risks to privacy and safety for women and girls.  We don’t want to create safe havens within our women’s restrooms for pedophiles and predators posing as transgenders who could abuse the law in order to victimize.

Would businesses have the additional expense of altering their public accommodations?

Would companies be forced to abandon traditional business dress codes in order to accommodate the dress choices of transvestites?

Is the council concerned about the impact that would have on small businesses and jobs in the county?  Would the potential liability exposure of compliance with the law be too great for small businesses?

Does the Education requirement mean that Gender Identity considerations will be written into our children’s school curriculum? 

Will teachers and students be required to have transgender sensitivity training?

Does it mean a boy considering himself a girl would have the right to play on girls sports’ teams and share the girls’ locker room?

Does it mean that transvestite teachers would be permitted to cross-dress at school?

Is Councilman Quirk subscribing to Pelosi’s legislative MO of sign now and ask questions later?
