TSA airport screeners gone wild in San Diego- again

In what can only be described as TSA handlers gone wild, the San Diego Harbor Police arrested an area resident for refusal to complete the screening/security process yesterday. This is the same airport that created the TSA security catch phrase “don’t touch my junk.” John Tyner of San Diego started the airport screening firestorm last week as Americans head into the busiest travel week of the year in the United States.

This time the defendant, Sam Wolanyk says he was asked to pass through the 3-D x-ray machine. When Wolanyk refused, Transportation Security Administration (TSA) personnel told him he would have to be patted down before he could pass through and board his airplane.

Wolanyk said he knew what was coming and took off his pants and shirt, leaving him in Calvin Klein bike undergarments.

“It was obvious that my underwear left nothing to the imagination,” he explained. “But that wasn’t enough for the TSA supervisor who was called to the scene and asked me to put my clothes on so I could be properly patted down.”

It was clear to Wolanyk that TSA only wanted him to submit to a pat-down and if they were interested in ensuring the safety of all passengers they would have rifled through his clothes, carryon baggage and acknowledged that he was not carrying any illegal paraphernalia on his person.

Once Harbor Police arrested Wolanyk, he was handcuffed and paraded through two separate airport terminals in his underwear to the Harbor Police office located inside a different terminal at the airport than Wolanyk had originally gone through during his TSA security process.

The incident was confirmed by Harbor Police Sergeant Rakos who said Wolanyk was arrested on two misdemeanors, “failing to complete the security process; violation code 7.01 and illegally recording the San Diego Airport Authority (they confiscated his iPhone); violation number 7.14 (a).” 

Another confirmation came from Ronald Powell, director of communications, who said Wolanyk wasn’t charged with any federal crimes, just the two misdemeanors. “The bottom line is that all our police officers did was enforce the law.”

Powell also stated that there was another arrest of a woman who was allegedly illegally filming the x-ray, and TSA screening process with a video camera. The young woman’s camera was confiscated and she was given a citation and released from Harbor Police custody.

TSA headquarters has told would-be airline travelers who enter an airport checkpoint process and refuse to undergo the method of inspection designated by TSA they will not be allowed to fly and can face possible charges for disrupting the airport security process.

Wolanyk will appear in court on January 7, 2011 to dispute the charges with Jason Davis of Davis and Associates of Orange County by his side.

We are extremely disturbed by the TSAs recent action and are looking to oppose those actions by all legal and civil means.

    So quick thing I would like to bring up and I haven't heard anyone address it. OK, with TSA they are saying there are 2 choices. The Technology that could not possibly be deemed safe because the fact is there and has never been this sort of experiment on a large scale population, hello peoples DNA are different, just b...ecause it didn't give mice cancer means nothing. Which is concern #1, and more importantly #2 I haven not seen any agent change his/or her gloves...once! I mean they're digging into peoples pants, think of disease and bacteria...staph infections? bacteria?...Feces? Its completely unsanitary! Its not safe! and who knows where those gloves have been! There digging into grandpa pants because he cant get out of a wheel chair and turning around and touching our children! Its discussing!

    I thought about employing this strategy. First, I was going to do sweat pants so that my zipper wouldn't set the alarm off. Of course, I heard about the DJ who was told that TSA checks if you are wearing baggy or loose-fitting clothes. So then I thought about wearing a speedo and the wife could wear a bikini, all under long jackets we have. Or to wear it under our clothes and just drop our clothes if patted down. With this story and a woman with a skirt who was yelled at by TSA, "don't do that; spread your legs", this looks to be out the window as well. We don't want to fly any more. We bought tickets to fly home for Christmas 3 months ago. Nearly $2000 unrefundable, for 4 people. Very ugly situation. Coincidentally, Southwest is launching a $59 sale in the middle of the busiest travel season of the year. Interesting....the boycott is coming.

    I think all men that fly this HOLIDAY should wear a Catchers Cup. Think of what that would cause as in STOP ALL AIRLINES from boarding. Hell even the Women. Think about it 3 million fliers going threw pat down and everyone has a cup on what the fuck they gonna do then.

    Give your ticket back -- get your rights back. :-)

    There is so little probable cause to hold a person for questioning because they refused to be electronically ogled or personally pawed at the airport (the $11,000 thing) that it probably violates the rational test. If you could not hold them without the rule -- because the Fourth Amendment says you could not. For the same reason you cannot make the rule to hold everybody for questioning to catch the one in a million bomber (who will never decide to leave because of privacy concerns -- who is leaving in any case; no imminent danger -- ergo, not even a rational relationship to a valid state objective: Fourteenth Amendment violation).

    Which brings us to the partially depersonalized strip search or too private groping (most in public view! -- I've been on 150 prison visits with no aversion whatsoever to the most serious but normal, private parts free, frisking). You could not make such an invasive rule under the same one-in-a-million type risk situation anywhere else in life.

    Don't like it, don't fly? Too easy; this is not 1950. Flying is as much a part of everyday 2010 American life (3 million passengers a day -- a billion passengers a year) as anything else. And what does it take to outflank the TSA's Fourth Amendment free Maginot Line: one 300 pound women with enough room between her cheeks to hide all the fixings of a Thanksgiving dinner. :-)

    Case closed: I think most people would take the risk level of driving (10X the danger of flying) if all other things could somehow be held equal (convenience, price) over living in the condition of perpetual prison convict humiliation.

    I agree, give your ticket back. If the TSA won't listen to citizens, I'll by God bet they will listen to the airlines! It's time for a little public revolt here to get this process back to a more resonable police state.

    I would never let anyone touch my kids.. Take off their SHIRT???
    I used to be a travel agent and I found most the screeners were just minimum wage earners. Like the security officers at the mall???
    This is so unreal on so many levels, I will not fly until there is a better system, like maybe PROFILING...

    Great post Draw. Your case is bolstered by your minor miscalculation of more like one in a billion bombers. We don't lose a plane a year , I hope. But you know dam well the planes that do go down will be at the hands of muslims.

    Your comment isn't clear. Are you saying give your ticket back BEFORE you are searched--or after it becomes too intrusive? Remember, this guy was charged for allowing the search to start but refusing to submit to what he thought was an intrusive search. They called it “failing to complete the security process; violation code 7.01". Perhaps this guy wants to be Rosa Parks, but not everyone wants to be arrested to make a point.

    I think if everyone quit traveling via plane, they would get the point.

    Kathy, chill out. randy has a point. This one possible way the government could go. You sound like an ideologue. Anyone with any sense knows that Bush started the bailout program and obama has simply increased it several fold. The airlines would not be above asking for a bailout. Also, while the Bush admin started these body image machines for the airports in terms of planning, the Obama admin has gone head first in the implentation of this program and then grossly compounded it with the intrusive pat-downs of everyone, including the eldery infirm, women and children. Don't look at this through Party or an ideological perspective. Look at it through your perspective and those of your family.

    These rules are not in place for safety, they are designed to control the masses. Once people get used to the checks and patdowns, another government agency will begin to use them, until there will be no place an American can go without being groped. It's for security, don't you know.

    To prove it, people who film the encounters are arrested. Remember, sunlight is the best disinfectant.

    You have that right sir, the word "freedom" is reseved for those who would use it against us. This TSA is the first step to a police state under the guise of security. The land of the free has become the land of the enslaved. Your Government is not out to preserve your safety but rather to compromise your freedom. All of this under Obamas watch. Security after the towers seemed to be working just fine until someone got through the security of another country. not this one. As a consequence we have "let loose the dogs of war" in the person of theTSA.

    Greyfox, last year, under Obama's administration, the House passed a bill to ban the porno scanners. Senate failed to pass that, however- the same Senate full of Republicans and Lieberman who destroyed a lot of Obama's good attempts. We've a system of checks and balances, which means Obama can't fix anything with Congress bullying everything he does.

    The Democrats have been in full control of Congress since 2006 --- in 2008 the Democrats had full control of both the Senate and the House and also a willing President. They could pass anything they wanted. The had veto-proof majorities and were fillibuster proof.

    If Obama wants a bill passed to ban the porno scanners, both the House and the Senate could do so without a single Republican voting.

    I just love how you say Obama can't fix anything --- the democrats were in full control -- how do you think we got Obozocare without a single Republican voting for it ?

    Lynne- You obviously haven't been paying any attention to all the tricks by the Republicans the last two years in congress. The Democrats did NOT have a filibuster-proof majority. Don't forget about the blue dog democrats either. The Republicans have stopped plenty of bills moving forward in the senate using the filibuster and the Democrats haven't had the votes to end them.
