Report--Obama demands access to Internet records without court review

'Big Brother is watching you.'  Yet another move toward a totalitarian government has secretly occurred that bears ominous signals for personal freedom.

Barack Obama is demanding access to the Internet records of average citizens, in secret, and without court review.

The Center for Research on Globalization reports the news:

"The Obama administration is seeking authority from Congress that would compel internet service providers (ISPs) to turn over records of an individual's internet activity for use in secretive FBI probes.

"In another instance where Americans are urged to trust their political minders, The Washington Post reported last month that "the administration wants to add just four words--'electronic communication transactional records'--to a list of items that the law says the FBI may demand without a judge's approval."

"Under cover of coughing-up information deemed relevant to espionage or terrorism investigations, proposed changes to the Electronic Communications Privacy Act (ECPA) would greatly expand the volume of private records that can be seized through National Security Letters (NSLs).

"Constitution-shredding lettres de cachet, NSLs are administrative subpoenas that can be executed by agencies such as the FBI, CIA or Defense Department, solely on the say so of supervisory agents.

"The noxious warrants are not subject to court review, nor can a recipient even disclose they have received one. Because of their secretive nature, they are extremely difficult to challenge.

"Issued by unaccountable Executive Branch agents hiding behind a façade of top secret classifications and much-ballyhooed "sources and methods," NSLs clearly violate our constitutional rights."

Under the new directive of the Executive Branch, any telecommunications entity that refuses to comply with government demands for records that are supposed to be private can be slapped with jail-time or fines.  This extends to individuals within those corporations, in addition to credit card companies, banks, health insurance companies, airlines, video rental services, book sellers, and libraries.

This new initiative would give the Obama White House unprecedented, sweeping power to snoop into the private communications of every single American.

And the Obama Justice Department has lied about the intent of the directive, claiming that it would grant no power to government to gain access to 'email content.'

FACT-CHECK!  The directive does precisely what the DOJ denies due to its provision that allow the Feds to arbitrarily seize private records containing email addresses, the dates and times they were sent and received, and a live 'snap-shot' of anything the user looks at or searches while online.

In addition, according to the Global Research report,

"As I have pointed out before, most recently last month when Idescribed the National Security Agency's PERFECT CITIZEN program, the roll-out of privacy-killing deep-packet inspection software developed by NSA already has the ability to read and catalogue the content of email messages flowing across private telecommunications networks."

The 4th Amendment to the U.S. Constitution, contained in the Bill of Rights, states, "The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no Warrants shall issue, but upon probable cause, supported by Oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized."

Apparently the Obama Administration, federal government operatives, and their enablers in the Democrat-controlled Congress view the 4th Amendment as a mere nuisance standing in the way of their quest for unbridled power.  And, as we have seen numerous times, Constitutional provisions never stop this Administration from that relentless pursuit of totalitarian power.

This is but one more compelling reason to clip the wings of these tyrannical oppressors by initiating overwhelming changes in Congress in November.

If you want to kick the bums out, then certainly there are others waiting in the wings that would not do such things. We already know the Republicans supported these activities during the Bush administration and the Dems cried foul. Now the Dems are doing it with the slight adjustment that they are specifically going through Congress to approve the rights to do it. So which politicians will actually follow through and oppose allowing the FBI to obtain these records during terrorist surveillance activities?

Martin, the Bush administration was doing this illegally starting right after 9/11. They got caught in 2005 and the ACLU and EFF (Electronic Frontier Foundation) launched what became a series of lawsuits against it.

FISA law was amended in 2008 to expand NSA powers to monitor Internet and phone without warrants; this latest is basically a loophole plug.

I'm not a big fan of ACLU because they seem to not understand the 2nd Amendment - but they and EFF deserve props for fighting the good fight against this whole "sacrifice privacy for security" mindset.

And both political parties are in the wrong on this one.

Congress does NOT have the legitimate power to overrule the U.S. Constitution with legislation. It REQUIRES a constitutional convention. Attempting to subvert the Constitutional restrictions via legislation results in voidable legislation. Throw the supporters of these type bills out forever.

With very, very few exceptions, all incumbents should be removed from office at the earliest opportunity.

Both the Demoncrap and Repukicrap parties should be ignored and allowed to die out.

There's nothing in the Constitution about a two party political system. We don't need political "parties" PERIOD. Quit thinking in terms of political party and start thinking in terms of individual freedom and limited government!

exactly both parties are not acting in favor of the American people in fact they both want to take away our rights and subvert the constitution they simply argue about the semantics of how to do it.

I think this stinks....it's just more intrusion into our lives by an overbearing government that's out of control, and has little if no regard for our constitution or our rights. This will be ushered through quietly with no media coverage....much like Hillary's small arms agreement with the U.N. ! Barry O., long after he's removed from office either by vote or impeachment, will find his legacy will live in the annals of infamy like no other president we've ever had !

Phil, that hasn't even got out of the UN. Clinton signed an agreement that final language must have unanimous approval by all member nations before being submitted to those nations - want to bet how many decades that will take to get?

Even if it gets out of the UN, it then has to get two-thirds approval in the Senate before it can go to the President for ratification. Ain't gonna happen.

Lots of gun rights issues to fight out there; this is not one of them.

Snark......The U.N.Small Arms Treaty Agreement is expected to go through the U.N. by years end or sooner ! The 2/3 approval by the senate is neither here or there....Barry O. has executive order capability anytime he wants...all that is needed is reason such as a reason to call for martial law....a October surprise. Consider that NorthCom has been training for years with U.N. troops in OUR country for years now, preparing themselves for urban warfare. Consider that the man without a past want to snoop on you and I and everyone else, and he wants OUR weapons. Sound familiar....it should. Moves like this were done in pre war Germany, Russia and elsewhere. I would consider again if you don't think that these are paramount in their importance. Like Brit has stated above....the man without a past, who keeps information about his life away from the citizens of this nation wants to take your guns and get as much information on you and I that he possibly can. If just these two things happen, we are forever lost as a nation and will be dragged down into the abyss of socialism/Marxism !

$50 says your full of crap, Phil. No martial law this year nor under Obama, period.

To start with, executive orders cannot trump the 2/3 consent requirement on treaties. Period.

And Northcom has not been "training for years with UN troops in OUR country" - as someone who still talks to Northcom folks on a regular basis, I KNOW that is pure bull.

We have more than enough genuine problems and issues to deal with without embracing your particular lunacy.

A source inside the MS Militia that is also in the US ARMY has Confirmed that several buses with blacked out windows delivered approx 250 -300 Troops some in NORTHCOM uniforms others in Pakistani, Turkish, and Russian uniforms. The troops were delivered to Camp Shelby in MS on December 17 2009. Another witness asked why they were here and he was told that he did not need to know. We are working on getting photos of them and their uniforms. (Note its not uncommon for foreign troops to be at Camp Shelby) It does seem out of the norm that foreign troops have on NORTHCOM Uniforms. Now as long as they stay on base that is fine but the moment they are on our streets they will be viewed as a threat to our sovereignty. http://freedomfighterradio.net/2009/12/17/foreign-troops-spotted-wearing...

How can you have a country where your own constitution doesn't exist?
If everything you hold private and personal belongs to the gov. and and the only thing you are not taxed for is the air you breathe. Even that is also in the works.
There also should be mandatory poly tests for every bill suggested by them.
Maybe a psychiatric evaluation of the suggester for the rest of the country to see.
Probably that too would be fudged.

Snark.....You say you talk to NorthCom folks on a regular basis when others are told by NorthCom that they have no need to know whats going on ! I as an ex military man (intelligence/liaison) I can tell you that everyone in the military knows that the military does not divulge information to civilians unless the civilian is an operative for the federal government ! NorthCom has been training for years with U.N. troops in the art of urban warfare ....NorthCom even wears the U.N. patch. Maneuvers are taking place all the time everywhere around our nation....one was recently held in Chicago. You can trace NorthCom/U.N. urban warfare training back to the days of Donald Rumsfied...pre 2006 ! You say what I've stated is lunacy...urban warfare training in OUR nation is lunacy.....further control by the fed or our internet is lunacy.....lunacy is OUR federal government spying on it's civilians ! By the way.... their is an agreement between the U.S./Canada and the U.N. to combine forces for urban warfare if and when needed here in the U.S. and likewise with Canada....you'll find this information under REX 84 and HR 645. I have a very precise list of E.O.'s and HR bills that are on the books, and each one of them are directed to take away OUR freedoms. The stage is set and the players have arrived fully rehearsed in what their jobs are.....all that's needed is for Barry O, the man without a past, to give the order. I suggest that you start reading F.E.M.A.'s EXECUTIVE ORDERS and look into what those F.E.M.A. camps are all about....you know ....the one's that have the razor back wire pointed into the compounds to keep people in....not outward to keep people out ! Without guns this is where people will end up....without communications (internet) no one will ever know !

  • PHILesq 1 year ago

Snark.....as an ex military intelligence/liaison I doubt very seriously that your "talks" with NorthCom "folks" reveal any relevant or pertinent information....that is unless you're a civilian federal operative working for NorthCom. It seems that the link below your return comments to me say's it all. NorthCom and the U.N. have been training together for years in the art of urban warfare....since the days of D. Rumsfield running our military .....pre 2006 at least, and they have recently ran training ops in our cities....Chicago for one ! I suggest that you look into REX 84, Operation Urban warrior, HR 645 to name a few. I stated that Barry O. doesn't need the 2/3 approval by the senate and it stands....all that is needed is a false flag operation to mandate martial law ...hence NorthCom/U.N. combined forces all fully trained and ready to go....and by the way their hand picked for this kind of operation...elite forces that will do exactly what their told to do ! So we have the F.E.M.A. camps already, troops trained, and a loose cannon for a president....a man without a past ! They want OUR weapons and they want to control all medias including the internet and I.S.P.'s....that should cause every American to be more than concerned. OUR economy is nothing without OUR freedoms. You might find work when your freedoms are taken away.....but there will be a boot on your back while you do it!

Take off your tin-foil hat and try reality, Phil. Northcom is one of the most open military organizations around - and the only thing you have correct is that they have close coordination with Canadian forces because the Northcom commander also is the NORAD commander.

And yeah, I do have pretty good info - I write and consult with DoD and HS on a variety of issues, based on my almost three decades in uniform... including enlisted MOS in 11, 18 and 35 and a reserve warrant in 351 (as ex-mil intel you surely know what those are, right?)

Barry should get another Nobel Prize! This one should be for "Lying While Looking Sincere."
Note please, how the devil speaks from two sides of the mouth and from other orifices.
On one day he complains that the mosque should be built because of Freedom of religion and expression. On the next day, it becomes, "Ban Freedom of Expression."
When I hear him speak or when I see him on TV, I change the station or the channel .

To make the field even I'd like access to the Internet records of every federal pervert stranger whose obsessed with my online messaging and activity (including this comment). The founding fathers are turning in their graves and looking at America from above with tears seeing how the bill of rights, a sacred document of democracy, has been prostituted in the name of security to our "angelic" FBI protectors who we clearly cannot trust anymore.
