U.S. Federal Court Judge John Roll, who was shot and killed along with five other people in Tucson Saturday morning, once ruled against background checks for handguns and called the Brady Bill "unconstitutional".

In 1994, Roll said the Brady Bill was a violation of the 10th amendment of the Constitution which states that powers not granted to the federal government will be determined by the state. The Brady Bill required federal background checks for all those purchasing handguns in the United States.

The Bill was enacted in 1993 and was sponsored in honor of Jim Brady, Ronald Reagan's aide who was wounded during the President's 1981 assassination attempt.

Roll and 18 others were shot outside a Safeway grocery store Saturday, January 8th. Roll was visiting friend and colleague Congresswoman Gabrielle Giffords, who was hosting a constituent meet and greet session outside the store as part of her "Congress On Your Corner" series. Giffords was shot point blank in the head, but is expected to survive.
A 9-year-old girl and a church pastor were also among the dead.

In October 2010, Jon Stewart and Stephen Colbert hosted the Rally to Restore Sanity and/or Fear to call attention to the inflammatory rhetoric in the current political discourse. The shooter, Jared Lee Loughner, posted several anti government videos on YouTube.
Pima County Sheriff Clarence Dupnik pointed to vitriolic political rhetoric in the media as partially to blame for Saturday's bloodbath.

And saturday's shooter passed such a background check, and the checks wouldn't have found anything about him.
They aren't prescient or flawless, they don't cover things beyond criminal activity, domestic violence misdemeanors, or being involuntarily committed to a mental institution.
Bad attitude doesn't raise any flags.
