Appeals court: Woman awarded $50,000 after man breaks engagement

Saturday, after a man in Georgia was ordered by a court to pay his former fiancée $50,000 after he broke their engagement and he is still pondering if he should appeal; Christopher Ned Kelley is now trying to decide if he will appeal the court’s decision, reported ABC News Saturday. The news has created a buzz.

Kelley’s attorney used the defense that he never used the words, "Will you marry me?" But he did purchase a ring for $10,000 and give it to his fiancée, Melissa Cooper. In 2004, Kelley gave Cooper the ring and they moved in together, he asked her to quit her job to watch the children (one they had together and one was hers from a previous relationship) and she did. A few years later, she found out about some other women he was seeing at the same time. She confronted Kelley and he said he wanted to be with one of the other women and that she should move out.

Cooper filed a lawsuit that included fraud and breach of contract to marry. Friday, she was awarded $43,500 and attorney fees of $6,500 by the Coweta County Superior Court in Georgia, ABC News reported.

Kelley appealed the initial court decision stating that they were not serious and that they didn’t talk about getting married. In court, when he was asked about other relationships with women he replied: "It's possible."

The ruling was made on Nov. 22 and they upheld the initial court’s decision stating that the promise to marry someone is enforceable in court.

Kelley would not make a comment.
