The lawyer for Supervisor Ed Jew said his client should not be removed from office without due process on the federal charges he is fighting.

SAN FRANCISCO (Map, News) - Supervisor Ed Jew plans to file a restraining order against The City if misconduct charges that stem from an alleged bribery scheme are filed, his lawyer said Sunday.

Steven Gruel, an attorney for the embattled District 4 supervisor, said he would likely seek a restraining order from a state or federal court within 24 hours of the misconduct charges being filed. The restraining order would be an attempt to prevent Jew’s removal from his seat on the Board of Supervisors.

“Quite frankly, that would probably be the next step” if misconduct charges were filed, Gruel said. “Within 24 hours, I think we would be prepared to file something.”

Mayor Gavin Newsom is reviewing possible misconduct charges against Jew, which, if filed, would immediately remove Jew from his seat, after federal charges were filed last week against the supervisor in connection with an alleged scheme to bribe local business owners.

Jew pled not guilty Friday to a federal mail-fraud charge that alleges he threatened to create city-permit problems for Chinese immigrant owners of Quickly tapioca-drink shops in The City unless they gave him $80,000 in cash. Jew was released on a $1 million bond under conditions that he does not travel or attempt to intimidate potential witnesses.

The supervisor is now the target of two criminal cases. The other case is scheduled to begin Oct. 26, in which he is charged by the district attorney on nine felony counts for allegedly lying about where he lived in order to run for office last year. A preliminary hearing in the federal case has been scheduled for Oct. 11.

The Sunset district supervisor has denied all charges and continues to meet with constituents. He has ignored requests to resign from the mayor and his board colleagues.

Sources close to City Hall have said Newsom has been working with City Attorney Dennis Herrera over the weekend to draft official misconduct charges against the supervisor that would immediately remove him from office. Newsom on Friday visited Jew in his Sunset district home and asked him to resign.

Gruel said Sunday that Jew will not resign from his post and that he requested a meeting with Newsom for today. Gruel said misconduct charges would put the situation in “stormy waters.”

“I do know the supervisor will fight this. He has done nothing wrong. To deprive him and his constituents of his position without due process would be quite frankly setting The City up for a huge lawsuit” if Jew is acquitted of the state and federal charges, Gruel said.

Jew would be the first supervisor in The City’s history to face misconduct charges. Newsom would be required to immediately appoint a replacement for Jew to represent District 4 on the Board of Supervisors.

Let's see, Ed has loss his job and incurred the cost of 1) an administrative proceeding before the ethic's commission and Bd of Sups, 2) criminal trial, with 9000pages of documents and 66 witnesses, and 3) federal criminal case. Further, the City is now leaning on his income by "investigating" both his taxi medallion/license and now his rental income by looking at his pot club tenant. I guess its good that he and his family own, what, 11+ pieces of property. He's going to have to sell a few to pay off just his lawyer fees. Love it! I wonder if that crook in Berkeley got the same kind of dough to back up his fake claim....

If you think that former supervisor Ed Jew and his immediate family and relatives in San Francisco did not know he was living in Burlingame, you are naive! This is familial collusion at best and a legal conspiracy registered on the voters of District 4 at its worst! The immorality and ethics of the situation is that Ed Jew is dragging his family through this embarrassment oblivious to being an irresponsible, narcissistic and in a state of denial thinking he is above the fray. His supporters need to bring him back to reality because he is now longer a source of legitimate powe, legitimately earned and is divisive to the body politic of S. F. If his supporters do not disassociate themselves of this conspiracy, they are a party to it and want power regardless of whether it is legitimate or not. That is one symptom of creating and justifying anarchy and the loss of a nation!

A very odd statement by Bill Fazio that he wants off the [Ed Jew] case... due to "irreconcilable differences." I did not know that they were married and joined at the hip. But, this is San Francisco. I was sure there are better legal phrases that could have been substituted to part company!

To the commenters that keep going on about the Mayor's past...having casual sex with a willing partner in no way comes close to official misconduct. This is like apples and oranges here! Federal Charges of extorting money are pretty damn serious and in no way compare to a brief affair that obviously is some time ago. It is not illegal to have an affair with a willing participant! Yes, it may have not been the brightest move to make but still not illegal. Ed Jew is a greedy, selfish, self-serviing slob and I don't particularly feel sorry for the family either because how could they not have known what he was up too with regard to his place of residence. I am inclined to fall back upon "innocent until proven guilty" with this guy but the fact that he even has all of these charges going on in the first place is an embarressment. Yes, he could concievably be innocent but he should have put his constituents first and just stepped down of his own volition instead of putting everyone thru this. I suspect that he is probably in all probability guilty but he deserves his day in court...just stop draggin the citizens of his district through this along with every one else. This has turned into a three-ring circus with Jew as the center attraction (a big white elephant) and he should be ashamed of himself for even getting into the mess in the first place. I mean...Federal Charges are serious and the Feds are not going to go and charge someone unless they have a pretty damn good case against them. Read the Sunshine Task Force Judgement ... The official claimed the activity was a joke. I went to the Ethics Commission to file Official Misconduct charges with my Sunshine Ruling. Ask me if the ethics commission ever responded (unethical behaviour) except to disagree with and the "official" defintion from the city attorneys office. I assume their position was since the individual claimed it was a joke ... they could not judge. Here I had an admission and they could not juDge or agree with the defintion. Ed Jew has been the few voices of reason when the extreme close-minded liberals go too far. To lose him on the board would be a shame. He has been very responsive to the needs of the people of District 4. A few years ago, he went up to my home and spent time discussing issues that were important to us. NO OTHER supervisor in district 4 has done that and I have lived here for over twenty years. He deserves to stay on the board. As for people condemning him without knowing all the facts or seeing all the evidence..that speaks volumes about those people.
