Howard officials probing cop’s shooting of teens

BALTIMORE (Map, News) - Howard County prosecutors are investigating the shooting of two teenage boys by an undercover narcotics officer who claimed his gun accidentally discharged during an investigation of suspected drug activity in Jessup.

“Police-involved shootings are often reviewed as a matter of course by the state’s attorney’s office,” said Howard County State’s Attorney’s Office spokesman Wayne Kirwan.

Senior Assistant State’s Attorneys Danielle Duclaux and Lara Weathersbee, who is head of the juvenile department, declined to comment because the boys are juveniles.

Garcia Wilson, 15, and Dwaine Usery, 14, both of Jessup, appeared to be involved in a drug transaction when the officer accidentally shot them about 5:20 p.m. April 7 on the 8300 block of Pleasant Chase Road, police said.

Drugs were found at the scene, police said.

“They don’t have anything to charge my guy with,” said Wilson’s attorney Charles Ware, who filed notice of a lawsuit against the county in April and agreed to have Wilson meet with prosecutors about the investigation later this month.

“He was never in a position to be doing any illegal activity.”

Prosecutors are not filing criminal charges against Wilson, according to a June 5 letter, obtained by The Examiner, written by Duclaux to Ware.

“After consulting with Dario Broccolino, the state’s attorney for Howard County, and the Howard County Police Department, no criminal charges will be filed against your client. ...” Duclaux wrote.

Prosecutors would not comment on whether Usery will be charged, but his mother said Friday that her son is not being criminally charged and has filed a lawsuit against the county.

She declined to give her name or comment further until speaking with the family’s attorney.

The Police Department has been conducting an internal investigation into the officer’s actions, but refused to release his name because he was working undercover.

Police said two officers were conducting drug surveillance and stopped the teens for questioning.

As the officers got out of their vehicle, one officer’s weapon discharged, police said, and hit Wilson’s arm before striking Usery in the abdomen.

Wilson was treated and released the same night from Howard County General Hospital. Usery was flown to the Johns Hopkins Children’s Center.

Both teens were freshmen at Hammond High School in Columbia.

this does not compare what happen in st.petersburg dec.15 06...police did a undercover buy.cops got robbed then there back up ran kick in the door didnt not let the two others who was robbing the narc and the drug dealing they were cops.so as the undercover narc back up the start to shoot the one of the two kids....and also giving them 40 years in the pen... being a changed man and friends with one of the kids.this was injustice more thugs help me out to get on my feet now i live on the beach going to school to be a doctor and i was a thug

Maybe if the innocent would snitch on the bad guys in their neighborhoods the police would not kick in the wrong doors. I think the little punks should be charged, dress liks a thug, act like a thug than be treated like a thug.

I live in the neighborhood and know the two teens vaguely. They are not 100% innocent, but not bad kids. The cops here are way out of control. A year ago, they raided my house and an ex-friend on the force told me they'd "known" my house to be a crack house for years...um, of course, they found no drugs, as this house is not a drug house. However, I got arrested for having a tea filter in my bedroom, which was analyzed and found clearly to be something other than drug paraphernalia. So, long drawn out drama and an arrest to a hard working citizen who has never tried a drug nor cigarette in my life! Great cops are looking to get rid of bad guys, but, these cops: 1. Need to stop harassing the innocent, and 2. Learn how to do their jobs. No reason my house should have been raided with no drugs anywhere near, and no reason a gun should have been drawn on these two kids. They are actually two harmless, non-violent kids...

Are you people morons? There were multiple people at the scene and the police have not said who the drugs belong to. If drug use makes you a thug eligible for execution then you may want to begin with your former cocaine using beloved president bush the former substance abuser. Hmmm you may want to check with your relatives who use and execute them in your own loss of sanity.

Perhaps we should just be like Thailand or some other godforsaken place? Just have the cops execute alleged drug dealers and users. That will teach those Founding Fathers that we don't need their stinking rules.
