WASHINGTON (Map, News) - When Congress passed the 1997 Adoption and Safe Families Act, it allowed states to terminate parental rights after a child has been in foster care longer than 15 months.

But the law, intended to keep children from truly abusive homes from languishing in foster care for years, had unintended consequences. States receive a $4,000 cash bonus from the federal government for each child adopted, multiplied by the percentage that the state exceeds its adoption goal.

The system gives child protective agencies a powerful financial incentive to terminate parental rights, something that they did more than 79,000 times nationwide in 2006, according to the federal Administration for Children and Families.

And because infants and toddlers are much easier to place in adoptive homes, they’re often targeted for removal by overzealous social workers based on flimsy or anonymous evidence of parental abuse or neglect.

The 15-month clock, which starts ticking as soon as a child goes into foster care, can easily be run down by months of forced psychological testing and the filing of legal motions and other delaying tactics.

These tactics give a clear advantage to child protective service bureaucrats, who have unlimited time and financial resources to wage what often amounts to legal warfare against stunned and beleaguered parents who basically have to prove their own innocence.

If a person commits murder or robs a bank, prosecutors must prove he or she is guilty beyond a reasonable doubt. Not so in the Alice-in-Wonderland world of CPS, where individuals and parents are considered guilty as charged by anonymous tipsters whose hidden motivations are never brought to light. Once the 15 months are up, that fact alone can be used as legal justification to terminate parental rights.

It costs child protective agencies $20,000 on average to keep a child in foster care, versus $8,000 for in-home services for troubled families. This means that a host of lawyers, social workers, therapists, psychologists and other professionals make a lot more money when families are broken apart.

And although CPS’ stated goal is family reunification, the reality is that these agencies reap a second financial windfall when the forced separation between child and parent becomes permanent.

i just wanted to add that there is a federal law called the child welfare act of 1980, it states that cps is supposed to place the children with relatives if possible before placing them in foster care, but it also promises the states a lot of money for children in custody. what we have here is the most well protected terrorist organization the world has ever known. when i enlisted in the military i took an oath to protect this nation against all enemies foregn and domestic. but what can you do when you are not allowed to defend yourself, your family or your nation from itself? for almost twenty years of witnessing this stuff since my own nightmare began, i have seen this getting worse, not better by people trying in vain to fight this the so called legal way. WAKE UP PEOPLE!!! you will never win when you are the only ones trying to stay within the law! cps will always win if you are not willing to do what your country demands in time of war and kill the enemy. is there another way?

I am a former foster parent who is writing to confirm that CPS is corrupt. I lived in San Luis Obispo when they took my 16 year old daughter from school for no reason. CPS traumatized her for 6 months before sending her out of state. My daughter began cutting because they wouldn't let her contact me and she was sent to 6 different foster homes. This agency is filled with twisted sadistic individuals. They told my daughter lies about me and falsified reports. All of this was done to obtain Federal Funding. I have not been convicted of any crime and the only person who abused my daughter was CPS. I lost almost everything I had because of CPS. We MUST reform this agency before more children are hurt. Thank you all for sharing your stories. God Bless Senator Nancy Schaefer for speaking out about CPS this weekend in Washington DC. Lets keep educating people about this corruption!

I am undergoing the same type of injustice by Marion county's judicial system.It is surprising that there is no one willing to help families with this issue.Judges, lawyers, doctors, social workers and so called foster parents all benefit from the destruction of innocent families.This has got to stop. The promise of financial gain has prompted some to go after their own relatives in a vicious cycle of ignorance and abuse. If stopping abuse is their goal than why do they allow parents to be abused and humiliated some times right in front of their children and expect it to have no affect on them? Is their anyone out there who provides help for families like mine who have gone broke fighting the foster care system?

Child "Protection" is, world-wide, the most totalitarian, abusive, destructive agency that you could imagine. Hundreds of thousands of children are taken from innocent parents by way of false reports, fabricated evidence, corrupt and / or ignorant social workers, judges, psychologists, etc. It's a virtual industry, estimated to be worth billions of dollars in the US alone. All it takes is one phone call, or one visit, and your child could be taken from you. Don't assume it can't happen to you, because it has happened to hundreds of thousands of innocent parents. Educate yourself, learn your rights, and fight for change. Nothing could be worse than having your child ripped from your arms, and sent to live with strangers (i.e., foster "parents") who, statistically, are at least FIVE TIMES more likely to abuse / murder your child than any natural parent. This is happening to us right now our daughter was taken at birth with false reports and we are 9 months in and we have gone above and beyond the requirments with 2 evals each and all coming out in our favor but they are making my husband do a third know when she is supposed to come home by oct.10th now she is going to reqwest a 3 month extention in oct which will get them out till their 15 months

That's the problem with having "mandated" CPS reporters in hospitals and doctor's offices. It provides an incentive for doctors to "snitch" on thier patients instead of trying to help them. It essentially motivates them to violate their Hypocratic Oath. It also makes many parents reluctant to seek medical treatment for a child's injuries, for fear that they will be accused of CAUSING the child's injury.

We did not know that the "child protective services" laws about "neglect and abuse" heavily motivate doctors and nurses to "cover themselves" in the event that true neglect and abuse comes to light. While doctors (including a young intern and an 11-month practicing pediatrician and some nurses) falsely speculated that there might be some "neglect and abuse", the real issue was that my wife simply needed a little empathy and coaching.

Yes, and I thought I was doing the right thing by Little Sabrina by following his instructions and taking her to the hospital. In hindsight, though, taking her to VHC was a mistake, because it was there that the intern attending physician "snitched" on me to CPS behind my back, claiming that he suspected I was "severely autistic" and "lacking maternal instinct"!

When the baby's weight loss presented itself, on three office visits he kept repeating that there was "no problem" and kept recommending only 1/2 ounce of formula to supplement each breastfeeding. Nancy went in on a Saturday, a senior physician of the practice stepped in and said, "hey this IS a problem, please take yourself and the baby to Virginia Hospital Center (Arlington, VA)".

Our baby Sabrina was born on April 3, 2005. Little did we know what suprises the "child protective services" of Arlington County had in store for us. Sabrina was born, by Ceasarian section at Inova Fairfax Hospital. Mama Nancy stayed about 3-4 days at the hospital. Nancy, first time mother, made the decision to breast feed little Sabrina, and we later learned that many women have difficulty with this. In the second week of her life, Sabrina's weight went from 7 pounds, 4 ounces, to 6 pounds and 10 ounces. A Falls Church pediatric practice assigned their youngest and least experienced doctor to Nancy. Although I believe medicine is a tricky profession and that some mistakes should be given the benefit of a doubt, in retrospect, Nancy and I regarded this physician as having a bad "bedside manner" and poor communications skills.

Thank you, Barbara for *examining*this issue. I would like to give family members some hope about reforming CPS. California and Nebraska High Courts have just issued holdings which award damages to families torn apart by caseworkers. In the cases above, it was innocent Dads who were deprived of contact with their biological children, due to CPS' indifference. Also states like WV are now holding folks responsible for making false and malicious reports to DHHR. Consider that the Texas FLDS raid, was ignited by a hoax call from a known actor who harboured a grudge v FLDS. I urge famiies to use the 'Net to contact groups within their own state to band together to fight CPS illegalities and inanities.

The poor abused parents of this country need you. Please keep attention on CPS so that the public will finally realize the fear and pain that the children and parents are going through. I am a grandmother with 2 beautiful grandsons kidnapped by the "SYSTEM" who are well on the way to adoption their mother has done everything they required of her and still they are taking her children. She has been ensnared by the "Psych Evaluations" and they are using that as a reason to TPR her. Please continue to be our voice no one else will hear us, since everything is shrouded in secrecy under the guise of juvenile court system and that is kept secret. Again I thank you for letting people see the atrocities committed by CPS.

Yes to the post below, I saw that same letter from Social Services in another article where Margaret Donnelly instructed the social worker to not put anything in writing to let the Mother know how to get her daughter back.

It is not just CPS that does this. Courts, police and lawyers drag these things on so that memories or eyewitnesses fad. Investigate what is happening in Williamsburg/James City County. I have been trying to get an investigation into what is going on here and the rest of Hampton Roads for 2 years. Police and Officers of the courts block it, even to the point of deception, perjury, felony, misuse of public funds and outright lies. Since when does the Clerk of the Court's office not know how to issue a subpoena? Could it be when that subpoena is for information that may show wrong doing on the part of County and officals?

As a mother of two beautiful children who were illegally stolen from us by CPS-we have been fighting to get them back ever since (for 7 years). It doesn't matter if you are innocent-they won't reunify children with their parents because they want the federal money. I am the first woman in history to have a State Legislative Audit performed on my case-the auditors said," We cannot justify the state's removal of Jordan and Leigh Bierly". I still don't have them back and now they are adopted. I fight at the legislature for change but nothing will happen till we make these criminals who hurt children and their families accountable for their actions by holding Grand Jury Hearings for kidnapping,fraud,conspiracy against rights, perjury and a whole list of crimes. God Bless all the families affected by CPS. I will fight for the dismantling of CPS till the day I die.

Your right. CPS does not try to re-unify. In fact Title IV-E reasonable effort's states, DCYF (CPS) is required by Federal Law to provide the disabled mother with any services she need's to keep the child in the home. Disabled or not, nothing is done to keep the child in the home.The children are yanked out immediately. Relatives are'nt given the option of placement either. CPS tell's the Judge there were no relatives willing to take the child. If the child was given to relatives, less money would go to CPS. They don't care about children. All they care about is their incentive money and bonus'. They lie and play every dirty trick in the book to kidnap children from wrongfully accused parent's. All it takes in one false report and the nightmare begin's. Thank you so much for your articles. Ms. Hollingsworth, thank you for your article on the ruthless CPS. I live in N.H. and they are no better than the rest. My granddaughter was kidnapped by CPS because the CPS Lawyer told the Judge she was sure my granddaughter would be neglected in the future, not the past, not the present, in the future. There was no evidence or proof of my grandchildren being in imminent danger. Only hearsay. A woman perjured herself on the stand with no evidence. The Judge didn't even ask for any. CPS need's to be abolished and all children returned. We are emotionally and financially drained thank's to CPS' dirty tactic's. It's time to put them in their place. In the welfare line without job's.

I would hope that Dr. Krason would research cases in which more harm was doen in the foster home than in the birth home. Also, if a parent is trying to protect his/her child from an abusive spouse, there are laws in some communities that list the child as abused and charges are filed against both parents even the one who was trying to protect his/her child. No child should be removed from the home on the basis of an anonymous claim. Each claim should be investigated in a way that doesn't incriminate or label parents unless there is real evidence. Pychological testing is not objective and should not be considered authoritative in such matters. A person's attitude, belief, and behavior can change as he/she matures. Do we want to remove children from parents who are raising their children to have integrity on the inside and giving them to foster parents who pacify children so they appear ok to onlookers and pychologists? Psychology cannot measure true integrity.

We invite other local people who have been victimized by the overzealous CPS system to contact us through this. Hopefully there might be strength in numbers, so that a group of complaints can be gathered and lodged against this monstrous system. The media, political leaders and bloggers are invited to raise publicity, force changes to the law, and to conduct massive investigation of wrongdoing on the part of government officials. My wife Nancy and I, and Nancy's only surviving parent, (mine are deceased) have been emotionally and financially devastated by this horrific ordeal. We welcome any help, even a kind word, from the general public.

I printed it out too, its even got the signature of the social worker on it too, Becky Price social worker from the state of Missouri.

I heard about that case along time ago. There are two other little girls in that house that the state gave to that man too. That man who has that Mother's daughter from Missouri was also caught stealing money from his employer too. I read about this story in another article.

Social Workers are picked according to how easily they can be instructed to do the dirty deeds. Sorry to disappoint you, but you are way behind time. That Mother in Missouri was not even charged with abuse, plus she got to keep her other two children on top of that. Those state officials from that state of Missouri gave her daughter to a single male household with three teenage boys in the house when the little girl had a fit Mother with two other children! Those state officials should go down and should be prosecuted for child kidnapping.

As a person whose child was kidnapped under color of law by CPS, I have a shockingly intimate knowledge of the system. This article by Barbara Hollingsworth is right on the mark. When the CPS workers "draw a bead" on you, they sink their teeth into you like a rabid pit bull, and won't let go. They have the entire weight of the state arrayed against you. Your taxes pay for the CPS agency, the County Attorney's office (who prosecute the parents), the Juvenile and appeals judges, and various subcontracted psychologists, social workers, etc. In theory, they are supposed to be independent entities. In reality, they use the same buzz phrases and all act according to one script, termination of parental rights come heck or high water. There is zero assurance that these "independent parties" don't communicate with each other. They work feverishly to tear families apart, often over the most trivial and minor matters. Beware, it could happen to YOUR family!

Sure, there are some instances of "helping the children", but there are more instances of harming the families. The old adage was "it is better that ten guilty persons escape than that one innocent suffer," has been replaced by CPS with, "Kill them all and let God sort them out."

The courts may have TPRed parents in 79,000 cases in 2006 but there were over 500,000 children in care. If you really believe parents are the ones being mistreated by this system you need to read "Whose Best Interest". The parental rights laws presumes that what is in the "best interest" of the child is "family reunification." In fact, the law states that they MAY remove parental rights if the parents haven't been working on there service plan agreement within 15 months but they also MAYNOT. It's up to the judge not CPS. Hey, I'm not a big fan of CPS they failed two children I dearly love but it happened because the laws and courts are all about the parents not the children. Most of the time charges are assured anonymity and the "tipsters" cannot be sued by law - no matter how flagrant the slander or libel against the family. Also, DSS/CPS work on innuendo and accusations without having to prove anything in court. In some states there are laws that state parents are guilty until proven innocent. After years of litigation, if the families have any money left, any energy to fight, and can find an attorney to fight for them, they can try. But CPS is immune to most rebuttal because the family is then considered "convicted, evil, and child beating."
