A Rockville man who police say drowned his three young children in the bathtub of a Baltimore hotel room before confessing to the crime was indicted Monday.

A spokeswoman for the Baltimore City State’s Attorney’s Office said she could not comment on whether prosecutors plan to seek the death penalty against Mark Castillo, 41, who stands accused of murdering his three children March 30 at the Baltimore Marriott Inner Harbor at Camden Yards.

“We are continuing to investigate,” spokeswoman Margaret Burns said.

A Baltimore City grand jury indicted Castillo on three counts of first-degree murder and child abuse resulting in death in the killings of Anthony Castillo, 6, Austin Castillo, 4, and Athena Castillo, 2.

A judge in the case has barred attorneys from talking to the media and disallowed Amy Castillo from visiting her estranged husband’s apartment.

Mark Castillo is being monitored by the mental health unit at the Baltimore City jail.

Shortly after her children’s deaths, Amy Castillo, of Silver Spring, spoke publicly about her frustrations with the court system, which she said failed to keep her suicidal husband, Mark, away from her three children.

Castillo told Baltimore police he killed his children because of a “recent divorce stemming from domestic issues with his wife,” according to Det. Robert Ross’ report.

Castillo took 100 Motrin pills and tried to slit his own throat after drowning his children, telling paramedics: “I know what I did was bad. I did it. I drown the kids last night,” charging documents state.

An arraignment is scheduled for May 19 before Baltimore City Circuit Judge W. Michel Pierson.
