The United States Congress should confirm Judge Sonia Sotomayor and then send a bill to President Barack Obama officially ending the practice of affirmative action. President Obama and Judge Sotomayor achieved their places in history based on their natural talents and abilities. They earned their ruling class degrees and titles through hard work and dedication rather than entitlement. They obtained power, however, by surfing the misguided wave of affirmative action which now undermines the principle of equal and exact opportunity under law for all.
The concept of equal and exact opportunity under law is an important ingredient of American society enshrined in the Declaration of Independence. We are a free nation governed by the rule of law, not individuals, meaning that some individuals are not more worthy of opportunities than others. The U.S. Constitution and our respective state constitutions make sure that the laws, regulations and decisions facilitating our individual pursuits of life, liberty and happiness are not compromised by executive, legislative and judicial prejudice and selective promise. The proper role of government, after all, is to establish the rules of the game and enforce them in a manner that does not favor one individual or group over another.
Would Obama feel accomplished if his team won a basketball game because Obama’s individual free throws counted for two, rather than one? Would the American people respect Obama's accomplishment if they knew the referees refused to call fouls on him, but selectively called fouls on his opponents to fix the outcome of the contest? The answer to both of these questions is no. Obama, you and I would all know in our hearts and minds that the basketball association and the referees ultimately owned his victory.
The color of Obama’s skin and Sotomayor’s heritage will not define their legacies. Their executive and judicial decisions will. We, the People, have already placed our national promise in Obama’s hands and he has already violated our most favored principle of equal and exact opportunity under law. He is rewarding some banks more than others, some auto companies more than others, some unions more than others, some non-profit organizations more than others, some taxpayers more than others and some individuals more than others. Obama, for all intents and purposes, has taken affirmative action to a new political level and is rewriting the rules of capitalism and the role of government intervention in the market.
He is counting on Sotomayor to defend his usurpations of power.
Obama and Sotomayor both have learned through affirmative action that some individuals and groups can get away with being more equal than others under the law as long as it is politically correct. They will use this knowledge to advance their socioeconomic and political agendas. Affirmative action is their political Trojan Horse. It is time that we celebrate their individual accomplishments by officially ending all affirmative action programs. We are all equal under the law. Government should not decide who wins and who loses.
