A "moral obligation" to act against Bush

The following is the transcript of an e-mail interview with David Swanson, author of the book Daybreak: Undoing the Imperial Presidency and Forming a More Perfect Union and the co-founder of AfterDowningStreet.org.
 
 
1. What is the ultimate goal of the Arrest Bush movement? Do you actually want to see George W. Bush and Dick Cheney arrested and prosecuted?
 
Yes, we really do.  We are pursuing local, state, civil, foreign, and international strategies, and we are urging the incoming attorney general to appoint a special prosecutor at the federal level.  See http://convictbushcheney.orgWe collected a lot of signatures on petitions for a special prosecutor on clipboards in DC during the inaugural.  When carrying an ARREST BUSH sign during the days around the inaugural, it was difficult to take 10 steps without a request to pose for a photo.

2. How optimistic are you that Bush and Cheney will actually be prosecuted?
 
It is clearly more likely than impeachment ever was, and we clearly have a moral obligation to work for it regardless of the chances of success, in order to provide what measure of deterrence we can to future presidents and high officials.
 
3. What specific charges should be brought?
 
Torture, illegal war, warrantless spying, etc.  See "The 35 Articles of Impeachment and the Case for Prosecution" to which I wrote the introduction.  See Michael Haas' book on 269 war crimes.
 
4. What indications, if any, do you have that the new Obama administration will actually investigate and prosecute members of the Bush administration?
 
After comments made in his confirmation hearing, Attorney General nominee Eric Holder will be hard pressed not to prosecute Bush, Cheney, and their co-conspirators, or to appoint a special prosecutor.

When Senator Patrick Leahy asked if waterboarding is torture and illegal, Holder agreed that it is. When Leahy then asked whether the President of the United States can immunize acts of torture, Holder said that he cannot.

When Senator Diane Feinstein said that an Inspector General's report on politicized hiring, firing, and prosecuting at the Department of Justice is evidence that officials have lied to the Senate Judiciary Committee, and that doing so is illegal, Holder replied that he will review prosecutors' determination not to pursue criminal charges.

When Senator Orrin Hatch asked if the president has the authority to engage in warrantless surveillance, Holder said no.

When Senator Russ Feingold asked the same thing, Holder stammered and stuttered and called it a "hypothetical" but said no.

When Feingold pointed out that lawyers at the Department of Justice, the White House, and the Office of the Vice President had written memos that clearly sought to sanction illegal actions, and asked "What is your view of the President's Constitutional authority to authorize violations of the law?" Holder replied that the president does not have that authority.


 
5. What indications, if any, do you have from members of Congress that they will investigate and take legal action against members of the Bush administration?

Some have urged Holder to appoint a special prosecutor, including Senator Levin and Congressman Conyers.  That's what we want, not yet more Congressional investigations.  See: http://www.democrats.com/node/18769

6. What is your next step as an organization? In other words, how do you keep pressure on the federal government to make sure that this movement is not ignored?

7. What other events are you planning?

The big antiwar events upcoming are in DC at the anniversary of invading Iraq and in NY on April 4.
