Kansas - The Court of Appeals of Kansas has upheld the conviction of a man who, when pulled over for DUI, used his deceased brother's driver's license for identification.

After his conviction on DUI and identity theft charges, the man appealed, contending that under the wording of the identity theft statute in Kansas, a dead person was not really a "person," and therefore his identity could not be stolen.

The Court of Appeals disagreed, and upheld the conviction and sentence for identity theft.

The man also appealed the DUI conviction which he lost.
