Honduras court rejects Costa Rica brokered solution

The Honduran Supreme Court has rejected a Costa Rican brokered deal to restore ousted President Manuael Zelaya to power and has ordered his arrest if he returns. The court has charged Zelaya with crimes against the government, treason and abuse of power and has indicated that he will be subject to trial if he re-enters the country. This is primarily based on Zelaya’s efforts to hold a non-binding vote on changes to the constitution. Critics have indicated that this was an attempt to remove the one term limit on the presidency.

Further the Honduran Supreme Court has affirmed the legitimacy of the Micheletti’s government, stating that it was installed as part of a lawful “constitutional succession.”

This is a significant blow to the peace agreement negotiated by Costa Rican President Oscar Arias which the U.S. has backed. The U.S. has revoked the visas of four members of the interim Honduran government. Currently, the U.S. still has not recalled their ambassador and they have not imposed trade sanctions. However, the U.S. as well as virtually the rest of the world, remains committed to the restoration of Zelaya as president of Honduras.

This decision comes right before an Organization of American States (OAS) delegation is scheduled to arrive on Monday 24, 2009. The OAS delegation’s plan was to talk to all of the actors in Honduras, including government officials, churches, business people, presidential candidates and different civil society organizations. The goal was to discuss the Costa Rican peace plan. Whether the visit will still occur is not known at this point.
