
Richard McTear Jr is facing first degree murder charges for the death of Baby Emanuel Murray had his first day in court today. Bond has been denied and he is being held at the Orient Road Jail in isolation for his own protection.
State Attorney Mark Ober will be the determining factor in deciding whether or not the state of Florida will seek the death penalty. Due to the nature of the crime, it is very probable that Richard McTear Jr. will be faced with the death penalty.
In the moments following McTear’s arrest, he was captured on camera showing an emotionless, callous attitude. When asked how he could toss a baby on the interstate he replied, “It’s a dirty game, it’s a dirty game.” Determining whether or not McTear gets the death penalty rests heavily upon the time that Baby Emanuel died. If Emanuel died during a result of domestic violence, compared to premeditated murder, such as being thrown out of the car on to I-275, it is possible that he wouldn’t face the death penalty.
According to a Hillsborough County Sheriff press release issued on May 5, 2009, the Medical Examiner has determined that Emanuel Murray died as a result of the impact from being thrown on the I-275. Richard Anthony McTear Jr. faces the following charges:
· 1st Degree Murder
· Felony Battery
· Burglary with Battery
· Aggravated Child Abuse
· Kidnapping
