Is it a case of an irresponsible dog owner or an overly sensitive neighbor? That’s the issue
debated when a 62 year-old New Yorker filed a $500,000 lawsuit against her upstairs neighbor because of excessive dog barking.
The little yappers are two Chihuahuas who are accused of keeping their neighbor awake at night for the past year. She contends that complaints were made to the manager of the apartment building and nothing was done. Now the woman is having back problems and muscle spasms because of exhaustion and frustration.
Unfortunately this type of problem exists in every community where animal lovers are pitted against people who only tolerate pets. Sometimes it is a situation where pet people forget that not everyone thinks their four-legged kid is the most adorable creature in the world and other times it is a serious infraction of an irresponsible owner who lets their pet bark for hours on end.
The sad part of the story is these Chihuahuas are at risk for becoming homeless if their owner is found guilty.
Fox News invited two lawyers on the show to debate the issue. They said the woman knew she was moving into a building that allowed pets and they questioned why the owner was able to sleep at night, but not the downstairs neighbor. On the other hand, the attorneys admitted how miserable it is to be unable to sleep every night because of constant noise. They compared it to a form of torture.
