In papers filed with the court on Monday, the lawyer for Robert Halderman is asking for the judge in the case to dimiss charges against David Letterman's alleged extortionist.

The filing claims that was Halderman's charges resulted from the fact that the alleged victim was a celebrity and is not justified in the facts of the case.

Attorney Gerald Shargel also states Halderman "discovered evidence that Letterman had created and fostered an environment of workplace sexual misconduct that under any definition, amounted to actionable sexual harassment." He further claims that Halderman was merely trying to see the exclusive rights to a screenplay to Letterman and had even asked for a written agreement. That request, Shargel noted, is not usually the approach taken by extortionists.

But the most gossip-worthy information included in the filing is the claim by Halderman that the relationship between David Letterman and Stephanie Birkitt continued through at least last summer.
