
Starting Wednesday, Coloradans can collect rainfall without running afoul of the law. While no one was prosecuted under the ban on rainwater collection, homeowners technically did not have the rights to water falling onto one’s property. Rainwater rights are the property of the State of Colorado, and are distributed according to the most senior water claims.
On July 1st, that will change. Landowners will be allowed to collect rainwater, although there are a variety of restrictions to the rainwater collection. For example, the water must be collected in a well, and the uses of that water are restricted to allowed uses listed on the well permit.
Water is a highly valued resource in the West, but Colorado is self-sufficient for its water needs and even sends water on to drier states. However, the issues of water claim rights are complex, and Colorado has seven Water Courts set up to deal specifically with the use and administration of water.
