In a preemptive strike, CBS is suing the NFLPA over the right to use player names and statistics in fantasy football applications. CBS claims the NFLPA was threatening action over what it sees as use of their product for profit.
This comes on the heels of a lawsuit over fantasy baseball where the court ruled against Major League Baseball's argument that fantasy baseball companies should have to pay a licensing fee to use their names and statistics.
Since that ruling, CBS has stopped paying licensing fees to the NFLPA, appearing confident that they will achieve a similar result for the game of fantasy football.
This is a complicated issue with financial ramifications for sports leagues, fantasy football companies, and those who play the game.
What do you think? Should the names and statistics we use in fantasy football be considered in the public domain, free for fantasy football leagues and players to manipulate as they wish? Or is this situation no different than, say, the Madden line of video games, where they are required to pay a licensing fee for making money off of the NFL's product?
Where should the line be drawn, if anywhere? If stats and player names are ok, what about team names, uniforms and logos? Do you feel it is taking advantage of the NFL for us to use free information about them or pay a company to host a fantasy football league without compensating the NFLPA for it? Or should the NFLPA get over themselves and just let us fantasy football players have our fun, seeing as how they still make a killing from so many other revenue streams?
