I do not believe that most cops wake up in the morning and think to themselves “how can I deprive citizens of their rights today without getting myself shot in the process”. On the other hand, I truly believe that some do. We have the evidence.

Does it really matter if it is a criminal who is pointing their gun at you and threatening your life with lethal force, or if it is a cop who is threatening you? Either way, when you’re looking down the barrel of a gun it places you in imminent fear of death or great bodily harm.

Even if you broke the law by speeding for example, no one expects the cop to show up at the window with their gun pointed at the driver just for going too fast. This is because there are very specific times and circumstances when lethal force may be used and when it is not authorized.

So, it should come as no surprise to anyone when a cop sees a citizen minding their own business and who is not committing any criminal act, or is not about to commit a criminal act, the cops have absolutely no legal justification under color of law to draw their weapon and point their gun at anyone. Lawlessness is lawlessness and having a tin badge on your shirt does not give cops any special privilege to point a gun and threaten citizens with lethal force who are doing absolutely nothing illegal.

But some will if you dare to exercise your authority under Wis. Stat. § 941.23 to openly carry a gun. This authority is also a right protected by the Wisconsin constitution: The people have the right to keep and bear arms for security, defense, hunting, recreation or any other lawful purpose.  Art. I, § 25 (enacted 1998). Ignorance of the law is no excuse for you and me, so it is certainly no excuse for those in law enforcement either. This leaves us with only two available choices. Either these cops are ignorant of the law, or they are deliberately and illegally trying to destroy your statutory authority to carry a gun and your protected right to do so. It could be both.  Well cops, don’t expect your tin badge to protect you when you act like a common thug. If you decide to ignore the authority and the rights of citizens, do not be surprised if they sue you personally for everything you have. If you cops really can not tell the difference between lawful behavior and criminal behavior, get another job before you get yourself or someone else killed.

The cops put themselves and everyone else in the area in grave danger of being shot when they behave this way. Cops also put taxpayers at a great financial risk. As federal lawsuits are filed against these cops and their employers, perhaps large monetary settlements will finally send the message to law enforcers and their agencies that the Attorney General refuses to do. Quit harassing people and threatening people with lethal force who are not committing any crime.

JB Van Hollen made a big deal about his support for our carry rights before he was elected but he has totally dodged the carry issue ever since he was elected. As the states top cop, JB continues to refuse to issue a formal opinion about the authority granted citizens under Wis. Stat. § 941.23,the states 137 year old open carry law while he sees citizens continue to be arrested for breaking no law, and their property confiscated.

Perhaps JB is just waiting for the right time to issue a formal opinion, maybe after a citizen shoots a cop in self defense who unlawfully threatened them with lethal force. Based upon the cop behavior citizens are still experiencing today, I’d be willing to bet it is just a matter of time before that happens.
