The Wall Street Journal's Law Blog has reported that staff counsel from the SEC whose inappropriate email to Mark Cuban was made public on The New York Times website on Monday was a regular correspondent of the Dallas Mavericks owner.
Jeffrey Norris, who an SEC spokesman told the Journal was not actively part of the investigation of mamma.com or Cuban is currently being reviewed for possible disciplinary action. He nonetheless had an interest that can be fairly characterized as strange and over the top.
The email posted on the Times website takes Cuban to task for being part of an effort to distribute and finance a documentary called, "Loose Change" that sets forth a conspiracy theory about the 9/11 attacks and the involvement of U.S. government officials. If that weren't bad enough, the twenty pages of emails posted today on the Journal's Law Blog are almost creepy in their obsessive sounding interest in Cuban and his activities.
“Either you are really an anti-American ideologue or your allegiance to making money is significantly greater than your dedication to your country,” Norris told Cuban.
It's no wonder Cuban and his counsel decided to wage war in the media and get their side of the story out there and quick. Couple that with the statements from his attorneys which indicate the SEC didn't do all its homework prior to filing the civil complaint and you've got a seemingly messy situation that you don't expect after an investigation of more than two years.
