For the over-the-road driver, it is bound to happen at least once during your daily commute; and that is the required visit of the open weigh station.

Some drivers have questions about whether or not they are required to enter an open scale. This is especially true for pre pass holders.

The State of Louisiana has asked to be included in this article. They, especially would like to clear up any misunderstandings. They say "Unless you are given the green light, which is indicated in the on-board transponder, you are required to enter an open scale. If the highway sign shows that it is okay to bypass but the transponder either turns red or makes no noise at all, and the scale is open, you ARE REQUIRED to enter the scale, regardless of the sign on the road."

The State of Louisiana will be issuing citations of up to $500 to drivers who fail to enter their weigh stations, and are required to do so.

Many states have such policies and fines can range in the thousands for violators.

Some states require rental trucks, such as uhaul, budget and penske to enter open scales. If in doubt, contact the Department of Transportation, or the State Police. They are more than happy to answer any questions.

The State of Texas opens their weigh stations periodically but they spend most of their days performing these inspections on the side of the road. If you are driving and see a weigh station open, keep in mind that the State of Texas does not recognize the prepass and ALL Commercial Vehicles are required to enter.
