We hear all the time about police seizing large amounts of marijuana in raids. This might be the first time the police have given back large amounts of marijuana in a raid.
Kent Police returned the first part of 11-pounds of marijuana they seized from Matthew Zugsberger in February. Zubsberger, a medical marijuana patient, had the marijuana seized after police found weed and a scale in his trunk.
Zugsburger pleaded guilty to misdemeanor possession and served three months probation.
After his lawyer filed a petition to have the marijuana returned, the courts obliged.
But here's the best part.
Simply giving the weed back was apparently out of the question. So instead, the courts ruled that the marijuana be returned in 1 1/2 pound installments over seven-day increments. This is apparently because Washington law only allows for medical marijuana patients to possess 1 1/2 pounds of marijuana. Quick, do the math. If Mr. Zugsberger was busted for having 11-pounds of marijuana and was accused of trafficking because of that large amount, then after he plead guilty, the courts agreed to give him that weed back, but only 1 1/2 pounds at a time...seven times, how many pounds of weed does Mr. Zugsberger have? Thinking...thinking...thinking. Wait! 11 pounds!
So having 11 pounds of marijuana is out of the question. But having seven 1 1/2 pound bags of marijuana is A-OK.
A truly bizarre story, but at least it has a happy ending.
