San Diego bans medicinal marijuana

The fight over the use of medicinal marijuana in San Diego has taken another turn. The San Diego County Board of Supervisors has voted to temporarily shut down every establishment that distributes the product in unincorporated neighborhoods of San Diego.

A 45-day moratorium has been placed on these businesses while the county creates new laws regarding dispensaries. The measure passed with all five votes, making San Diego county part of a regional trend.

Two other cities in North County, Oceanside and Escondido, have passed similar measures. The primary concern of lawmakers is that they aren’t allowed to regulate these businesses and their methods.

Until now city governments have had a very small role in the distribution of medicinal marijuana. This is because it was a state law that was passed legalizing the practice; therefore the state government was in charge.

California voted for the Compassionate Use Act in 1996, legalizing the medical use of marijuana by licensed officials. The bill did not establish clear guidelines for the state in regulating the process.

Local governments have typically dealt with the issue since then, but were limited in their involvement. Now they are trying to regain control of the sale of medicinal drugs in their county.

San Diego County is determined to change the laws involved, and has suggested that the moratorium could possibly be increased another ten months if necessary. It appears medicinal marijuana clubs will be put on hold until new legislation has been passed that gives the local government control of the issue.
