
Pet food manufacturer Wysong Corporation has posted a press release announcing that they have won their lawsuit against Nestle/Purina Petcare. Purina was attempting to collect licensing fees for a process during which probiotics are applied to food. This process was invented by the Wysong company fifteen years ago. Due to the ruling, Purina has lost all claims to the patent given to them by the United States Patent Office in 1999. Wyong's counterclaim has not yet been litigated. In it they argue that Purina is guilty of patent misuse, antitrust violations, false advertising and decepetive trade practices.
With the rise of premium and natural pet foods in recent years, Purina has lost a lot of their market share. It is speculated by both Wysong and several others that this may have been an attempt to reclaim some of that customer base. If Purina had won, better quality foods that use this beneficial technology would become more expensive for the consumer because of the licensing fees involved. As someone who signed a petition supporting Wysong's efforts, I am very happy with the outcome of this legal battle.
