We might get to see the Carrie Prejean sex tape after all. TMZ.com reports that Vivid Entertainment --the largest porn company in the world --has written to Prejean's lawyer to obtain the rights. Apparently the tape was done in 2007. That means that she was over eighteen. It is legal for Vivid to distribute and legal for the adult public to view.
Does Vivid really need Prejean's permission?
If Prejean indeed sent the video to her then boyfriend and he then legally sold the rights to a third party who sold it to Vivid, they might not need her permission.
Prejean still had legal action against the old boyfriend for intentional infliction of emotional distress, as well as against the Miss California Pageant for leaking details of a confidential settlement.
Why is Vivid even asking permission? They should know that Ms. Prejean is not going to promote the project. Not all of Vivid's porn is ummm....opposite porn.
They are doing it for publicity of course. They're even pretending to take the moral high ground. They can state that they offered Prejean a million dollars for the tape and she turned them down.
Prejean wins either way-- she can paint Vivid as an extension of the liberal media-- she'll make it seem that Keith Olbermann himself was running the camera.
