
Miss California USA pageant officials are suing former Miss California USA Carrie Prejean to pay back the $5200 they ostensibly "loaned" her to have her breasts augmented. Prejean's filed suit claiming pageant officials violated her privacy when they told reporters her breasts were fake.
Civil courts will ultimately decide who is at fault and for how much.
There are no criminal charges pending…yet. If Prejean had said she would enter the pageant. took the free implants under false pretenses and then dropped out, that could be construed as fraud. That certainly was not the case, Prejean was in it to win it. The authorities claimed that Prejean was fired for not fulfilling her pageant duties rather than her political and religious statements. That dispute also will be settled by the courts. Prejean is alledging essentially the pageant violated her first amendment rights to expression.
On the other hand, if the pageant official had achieved access to her confidential medical records and then released them to the media that could be a crime under California law. Confidential information was alledgedly leaked regarding Farrah Fawcett while she was treated in a Los Angeles hospital. Medical personnel face severe professional consequences and even potentially jail time for releasing info about anybody that they shouldn't.
The pageant officials have countered that the confidential information wasn't that confidential once Prejean paraded around in a swimsuit during the competition. It became obvious.
This can be a fairly serious issue. When people give information to doctors, they expect that information to remain private.
There have been no suits for replevin—actual possession of the implants. If memory serves, Pamela Anderson actually offered her used implants on e-bay. It is unknown whether they were worth more than 5,200 dollars.
Hopefully this case will settle out of court. I made it through this article without a single pun or bad joke.
