Elena: Unwitting surrogate for Naveen Andrews and Barbara Hershey?

Naveen Andrews is living large after starting an intimate relationship with actress Barbara Hershey, 21 years his senior, and landing a spot on the t.v. show "Lost".
By a plethora of tabloid accounts that all seem consistent, Mr. Andrews has lived a wild life. He met an older, married school teacher when he was 16, starting having an intimate relationship with her at 18 and fathered a son by her. He was an alcoholic and sometime heroin addict while raising this child. He left the first son in London when he came to Hollywood.
In 2005 Andrews and Hershey took a brief break from their relationship. It was long enough for Mr. Andrews to impregnate a Czech/French actress named Elena Eustache.
Someone who knew Ms. Eustache before the pregnancy spoke to me on condition of anonymity. She was told by Ms. Eustache that Mr. Andrews offered to pay her to abort the baby. Elena declined.
Ms. Eustache had sole legal and primary physical custody of the child for a few years. Then in January 2009 Andrews took Ms. Eustache to court ex parte. Allegations were repeated by the media that Ms. Eustache said Barbara Hershey practiced witchcraft. There is no documented evidence available that substantiates that claim. Ms. Eustache had the fear that her child was being poisoned while with Andrews and Hershey. She based her suspicions on sudden severe illness and her knowledge that Andrews did not want to pay child support. The anonymous source was aware of these fears.
Judge Elizabeth Feffer granted the motion made by attorney Laura Wasser, and ordered sole legal custody to Andrews, allowing Hershey full rights to care for the child and requiring Eustache to pay for a visitation monitor, about $100 per hour, during her limited visitation. Andrews is allowed to take the child with him on location in Hawaii, and Eustache must pay all expenses for the monitor to go to Hawaii during filming of "Lost".
On October 5, 2009 Judge Feffer granted another motion by Attorney Wasser, giving Andrews sole discretion as to who should be the monitor. Ms. Wasser compared a mother with monitored visits choosing the monitor to a prisoner choosing his guard.
In response to a previous story, a few people were attacking Ms. Eustache, making claims that seem libelous to me. Having seen the lack of integrity in the Los Angeles Family Court, I feel compelled to come to Elena's defense. This woman seems to be a decent enough human. For the time I spoke with her, she was intelligent and appeared sober. We could not discuss the case, but Ms. Eustache has many accomplishments, including speaking over a dozen languages. The source who has known Ms. Eustache for decades said there was not any psychiatric problems she was aware of. Even though there was a gag order, there were apparently leaks to the press that said there was a psych eval on only Ms. Eustache. The reports all point to Ms. Eustache's alleged comments about Ms. Hershey practicing witchcraft as the reason for giving her child to Ms. Hershey and the father. So, it would seem the people who leaked the story did not know of any negative feedback from the psych report.
Am I missing something here? Even if Elena called Barbara a practicing witch, (for which there is no evidence that I am aware of), is that a reason Barbara, a 62 year old woman should get to act like the mother of this child? Is that a reason to make it cost prohibitive and without privacy when Elena spends time with her child?
Elena has Czech and French citizenship. I hope the whim of two Hollywood actors, an attorney and a judge are worth the embarrassment this should bring to our country.
