Should someone sue for being stupid?

It seems texting is not only hazardous while operating planes, trains and automobiles, but walking as well. Staten Island teen, Alexa Longueira, 15, was walking along a sidewalk while texting a friend and fell into an open manhole. The Victory Blvd. manhole, was left open by Department of Environmental Protection workers trying to retrieve cones, as they prepared to flush the high pressure sewer line. Miss Longueria was checked out at a nearby hospital and released with some scrapes and bruises and a less than pleasant odor. The family says they are planning to sue. But, should you really sue when you are being stupid, despite the stupidity of others?  Might prove to be an interesting case.
