It was a day of irony in Washington, DC Monday.

Justice David Souter, 69, spent his final day on the Supreme Court after nearly two decades on the bench.  Souter, who was appointed by President George H.W. Bush, and as a moderate conservative, Souter turned many legal heads as a fourth member of the liberal voting wing of the Court.  This left many legal experts to assume the court would overrule the landmark abortion rights decision, Roe v. Wade.

To the contrary, Souter joined in a ruling reaffirming women’s right to choose.  It was a decision that shocked the Bush White House and conservative causes throughout the country.

On the very same day that the surprise liberal retired from the Court, a case that Supreme Court nominee Sotomayor, who is to replace Justice Souter, her Appeals Court judgment case was thrown out.

In the Court’s last session in their calendar year, they declared that white firefighters in New Haven, Connecticut were unfairly denied promotions based on race.  The case becomes a landmark decision against minorities, claiming reverse discrimination was illegally conducted.

The ruling doesn’t eliminate taking diversity into account, but makes it much more difficult for employers to justify it as the only basis for hiring an individual.

Judge Sonia Sotomayor, President Obama’s choice for the Supreme Court, had ruled the city of New Haven made the right decision in throwing out test results for a test given for promotion within the fire department.

The decision comes just two weeks before Senate confirmation hearings begin.  It is
Viewed as a big boost to conservative groups opposing her confirmation on grounds of
performing as a judicial activist who bases decisions on her own feelings rather than the law.

The Obama administration continues to argue that her own decisions show her restraint to any new precedents beyond those already set by her own 2nd U.S. Court of Appeals in New York

Republican senators are already lining up to question her comments, repeated in more than half a dozen speeches where she has stated that a wise Latina woman would make a better decision that a white man.

Senator Jim Inhofe, R-Oklahoma has already announced his vote against her as a “foregone conclusion”.  On the other hand, Sen. Harry Reid, D-NV has already endorsed her and is trying for a speedy confirmation.

The lines are being drawn for a rough confirmation hearing.

If the vote were to be held along party lines, the Democrats have just added Al Franken of Minnesota after a bitter election count with former Senator Norm Coleman.  It should be a “cake walk” for Obama’s nominee. Like other nominees from the past such as former Federal Judge Robert Bork (who was voted down) and now Supreme Court Justice Clarence Thomas (confirmed after a bitter confirmation process), anything can happen and historically has in the past!

But there is something very disturbing that is festering underneath the Sotomayor hearings that begin in two weeks. .

An outcry of racism is being heard from the left before a single senator has questioned the judge.  It is making the rounds that should she be voted down for the vacant Supreme Court seat, the repercussions to the Republican Party with Hispanics could be monumental.

Not only is this talk ridiculous, it’s dangerous!  In a free society, when a word like racism can be so loosely thrown around, something very wrong is beginning to rear its ugly head in American politics.  It is not only wrong but it is selective.

During Clarence Thomas’s confirmation hearings, the atmosphere was full of tension and the questioning heated.  But there was never a moment that racism was ever leveled against the opposition.

This has become the new buzz word of accusation without fact.  Anyone can be labeled a hated word like racist in this country now and there is little rebuttal by the accused!   It is used so much by the left that it has become commonplace.

It is a word when used can destroy a person’s reputation by the mere suggestion of such a charge.  It has become a reviled word referred to so often that those using it should be considered slanderous.

Being confirmed as a justice means a lifetime appointment.  David Souter’s early retirement is rare.  Judge Sotomayor’s confirmation could mean many decades as a sitting Supreme Court Justice.

To suggest an opponent of her confirmation is racist for those views and anti-Hispanic is not only ludicrous, it’s downright Un-American!  Since when is it acceptable for anybody to simply drop the “R-Bomb” without merit?

Using the word racism is a serious charge.  The way it’s being used now shows a lack of judgment.  A mind so devoid of reason that the “R-Bomb” is all an undisciplined mind can sputter out.  It is now so frequently used to vilify Republicans that it’s second nature to many.  And it always seems to be the usual perpetrators.
Judge Sotomayor deserves to have a fair and balanced confirmation process.  Whether or not the accusations being leveled before any hearings are fair or not, let the truth be heard once the proceedings begin just as our constitution intended.

Let’s not become victims of this new “McCarthyism”.  Such debate tactics are outrageous
and infantile.  It may be newsworthy for some “news” networks to run opinion without disclaimer (does MSNBC come to mind?), but should be condemned by ALL Americans
who take these matters seriously.

I doubt Judge Sotomayor is interested in politicians and pundits alike dredging the depths of unconscionable desperation to win their point of view. Those who bring the word racism to the debate should be condemned by their brethren.

It’s fairly obvious who they are.  They appear nightly on MSNBC “News”/Opinion and other bomb throwing “news” channels.
