Sixty seats -- unless Ted Kennedy or Robert Byrd are in ill health -- would mean a likely filibuster-proof Senate and confirmation success for Sotomayor.
The timing of the Minnesota court's decision is good for Sotomayor, who was dealt a blow when the United States Supreme Court tossed her panel's decision in the Ricci case Monday by a 5-4 vote.

In the meantime, Franken's likely swearing-in will leave conservative Nebraska Democrat Ben Nelson as a key player along with former Republican Arlen Specter of Pennsylvania. And if Kennedy and Byrd are out on any given day, liberal Maine Republicans Olympia Snowe and Susan Collins may see their importance rise.
Of course under such a scenario, just about any "moderate" Democrat could hold sway, i.e. Virginia's Jim Webb or Mark Warner, for example. Of course, so doing will likely earn them the wrath of the Obama White House.
