Palin defamation suit could cost Moore thousands in legal fees

AP Photo

If  Sarah Palin decides to go ahead with a defamation suit against blogger Shannyn Moore, who wrote that the Governor resigned because she was under criminal investigation, it may give others who have been defamed the courage to go after other bloggers who can be accused of "malice" in creating unfounded rumors about them on the Internet.

Should Palin sue Moore, it could mean thousands of dollars of legal fees in order to defend herself.  It might send a message to other bloggers who can be accused of using "malice" in defaming public figures. (See an explanation below.)

Palin's attorney has already issued a statement accusing Moore of "false and defamatory allegations" in writing that Gov. Palin resigned because of an alleged investigation pertaining to the construction of the Wasilla Sports Complex.

On July 5, 2009, the Feberal Bureau of Investigation (FBI) took an unusual step of making an announcement that Palin was not under any kind of investigation. It said,

"There is no truth to these rumors out there in the blogosphere."

If Palin decides to make an example of Moore and files a suit against her, by the time the blogger finishes trying to defend herself, even if Palin does not get a judgement against her, the costs can run into hundreds of thousands of dollars.

Shannyn Moore was defamed by Palin's lawyer for saying that Moore had stated "as facts". Shannyn Moore said "rumors". The right has been defaming everyone they possibly can for years now - so the pot is calling the kettle black.

I just read Ms. Moore's blog and the responses. Odd that there were NO negative posts to her story. What a self-serving display of censorship Ms. Moore is showing.

    Dear Ms. Moore,

Can you say "Discovery"? I knew you could. It's time to find out who's been funding these vermin. I'll bet you the money trail leads right back to Hillary Central.

Wow, all I can say is hiLARious. "Self-serving display of censorship"? Obama has "no experience," compared to Palin? Do you people even read? Or for that matter, think before you speak? As I said, hiLARious, and sad.

Liberals are so mad now because their policies, Messiah, and control are being rejected by the country now and Obama hasn't even been in office for one year now.

Sarah needs to file suit at once and hold plague and trash like this accountable for their fiction.

Palin won't do squat. Reporting "rumors" is protected by the 1st Amendment and the fact that Martha Gore is unaware of this fact tells me she's just another right wing tool.

    Dalton -

Only a left-wing tool could come onto a webpage and defend "reporting rumors" at all. I speak for many though when I say thank you for describing why MSNBC is still on the air. What's being a tool got to do with the fact that Palin is allowed to sue for defamation against someone "reporting rumors." No, you're more interested in defending that very roach-like act in the first place because you have demonstrated to us the actions of what is required to BE A TOOL in the first place. If you weren't, you'd drop the party-caricatures and simply stand for what's right and what is wrong. But being the true tool that you are, we know you never possible could.

Moore did NOT state that Palin was resigning because she was under criminal investigation. What she said was there where rumors of an investigation and DID NOT state it as fact.

The story of "Housegate" that Shannyn eluded to was covered in print by the Village Voice and on TV on Keith Olbermann back in October, 2008. So this rumor isn't new.

Palin is a public figure and the rules apply differently to public figures with regard to malice and defamation. You can pretty much say what you want.

How about the lies told of Obama? He is a terrorist or he is a Muslim or he wasn't born in the US or he went to school at a Madrasah. All nonsense but Rush, Hannity and the other red Kool-Aid drinkers spewed it every day during the campaign season.

Sarah the maverick? No. Sarah the whining quitter? Absolutely!

Truth is the ultimate defense against slander. Ms. Moore reported that there was a rumour. There is. She did not report that the rumour was fact, she reported that the rumour was a rumour. Should Ms. Palin find a lawyer that will press a defamation case against Ms. Moore, then Ms. Moore will have no difficulty finding a lawyer who will jump at the pro bono chance to depose Ms. Palin.

I hope Ms. Palin DOES sue Ms. Moore! The Iquitarod continues!

i've been hearing rumors that ms. moore has a thing for palin and that this is one of those cases of a 'girl crush' gone awry. the story went that palin snubbed her advances. her obsession with palin seems to point to that. this lady is so completely locked on to the governor that she has seems to have little time for anything else. ms. moore won't answer my inquiries which seems puzzling if not concealing.

i suppose that there could be another explanation but then why the talk?
