Jaycee Dugard case: Attorney wins appeal to represent Nancy Garrido

Nancy Garrido, the woman accused of kidnapping Jaycee Dugard with her husband, Phillip Garrido, may be able to keep her attorney, Gilbert Maines.

Maines has been under scrutiny on allegations that he wrote a book about the Jaycee Dugard case, the allegations were severe enough to have him relieved as Nancy Garrido’s attorney. El Dorado Superior Court Judge Douglas Phimister fired Gilbert Maines on November 5, 2009 in response to the allegations. Maines filed an appeal and approximately five weeks later, won.

The decision to reinstate Maines to the case was made by a state appellate court on Tuesday, December 15, 2009. However, it is still up to Judge Phimister whether or not to put Gilbert Maines back as Nancy Garrido’s counsel. In an order issued by the appellate court, Judge Phimister has until December 24, 2009 to notify them whether or not he will reinstate Maines as Nancy Garrido’s attorney.

Though the appellate court did not point fingers at Judge Phimister they did state that they believed he had made an error by relieving Maines from the case. A statement reads, “In reaching this preliminary conclusion, we mean no criticism of the trial judge in this case, who has labored to address serious allegations leveled against Attorney Maines. However, on the record before that court on November 5, 2009, it appears that respondent court erred in ordering Maines relieved as counsel."

Nancy Garrido has been temporarily represented by Stephen Tapson who says he hopes Maines will be reinstated to the case.

Nancy and Phillip Garrido are accused of kidnapping and raping Jaycee Dugard when she was 11 years old. They have both plead not guilty. Their next court appearance is scheduled for January 21, 2009.
