The Boulder County district attorney is investigating allegations that Larimer County Sheriff, John Alderden, improperly conducted the examination into the ‘balloon boy’ incident and the Heene family.
The catalyst in the probe was a letter from the Heene family’s attorney, David Lane, to the DA stating that Alderden broke a Colorado law that prevents authorities from publicly releasing information in cases involving child neglect.
Richard Heene and his wife, Mayumi, may be facing such charges, along with contributing to the delinquency of a minor, attempting to influence a law enforcement officer, conspiracy, and false reporting. Each stems from an Oct. 15 incident in which the couple reported their 6-year-old son, Falcon, trapped in a runaway helium balloon.

Mayumi admitted the event was a hoax and was planned to gain publicity for a possible reality TV show. Falcon had been instructed to hide and never actually left the ground. He and his brothers were then told to lie to the media and law enforcement about the incident.
A spokesperson for Alderden, Eloise Campanella, told the Associated Press, “The sheriff stated that he does not believe he violated any laws.”
Lane told the Ft. Collins Coloradoan, “Each and every statement made by the sheriff is designed to further fuel the public frenzy against the Heenes and ensure that they will be convicted in the court of public opinion before any charges are even filed in this matter.”
Authorities, including the FAA, continue to investigate the Heenes and the ‘balloon boy’ incident, however, as of yet, no formal charges have been filed.
