Artie Lange's vindication postponed

TOMS RIVER, N.J. --- Comedian and radio personality,  Artie Lange ,was scheduled to get his day in court at the end of August to answer to charges of driving under the influence, but will  now have to wait till September to prove his innocences.

The Howard Stern Show comedian and author of the best selling book, "Too Fat to Fish", was originally
scheduled to appear in court last Wednesday for the pretrial conference. However the date was changed to
September 9.

Lange was charged following a minor traffic accident last month in Toms River, N.J. which is about 50 miles
South-southwest of New York City.

Toms River police say Lange's rental car struck the back of another vehicle. No one was injured during the minor fender bender, but Toms River police charged Lange with Suspicion of Driving under the influence based on officers observations.

Defense Lawyer Michael Grasso entered a not guilty plea for Lange on July 14. Grasso said the 41-year-old Lange passed several alcohol screening tests after the accident.

The comedian told Howard Stern during the live radio broadcast on Monday July 13 that he agreed to a
Breathalyzer test and that he blew a 0.0

Lange who admitted to his on going battle with addiction says he was not under the influence during the time of the  traffic accident.

    Maybe he wasn't "under the influence." maybe he was just being himself when the police arrested him and they couldn't tell the difference between drunk and stupid.
