
Justice is leaning left
If a person looks at the Norm Coleman v. Al Franken trial, you may want to look at it as an extra inning baseball game between The Minnesota Twins and The Washington Senators. It could go on forever.
Amid all the numbers, accusations, filing briefs, and prognostications, the whole thing is very simple. Who had more votes than the other guy? Clearly it is not that simple.
When the Bush v. Gore lawsuit occurred, Florida did not have governing standards by law for a recount, subsequently, each county could count those marvelous hanging chads differently, ergo, they had no "equal protection".
When the Coleman v. Franken happened, Minnesota did have a set of laws governing a recount, subsequently each county had four rules to interpret absentee ballots. Landslide Norm Coleman's attorneys repeatedly have used the words about "different standards" when speaking to the court about the recount.
They continue to pursue this Bush v. Gore line of argument that so far they haven't had any success with -- Franken lawyer Marc Elias
As the universe of votes keeps shrinking for Landslide Norm Coleman (these ballots have already been looked at. (Twice. Some, three times). With no success of equal protection at the Minnesota level, it remains for Landslide Norm Coleman and the Republican National Committee to pack their bags for Washington, D.C. It looks like they will lose in Minnesota and will want to play another game In Washington, D.C., extra innings, if they have to.
With the same type of court in place today with Roberts and Alito in 2009 instead of Rehnquist and O'Connor 2000, George Bush won on a 5-4 vote.

Please explain this--in 2000, William Rehnquist and Sandra Day O'Connor were on the bench, today they have been replaced by Justices Roberts and Alito. This is either sloppy research or tortured language. Bad, editor, bad!
