Have you ever seen a small child being driven on a motorcycle? How did you feel about it?
Apparently Texas legislators have a problem with little ones being exposed to the open road. And they did something about it. Texas House Bill 537 affects parents - and all citizens - who transport youngsters on motorcycles. It prohibits children under 5 years of age from being carried on a motorcycle.
The law is easy to understand and goes into effect on September 1, 2009.
The long version:
HB 537 -
makes it an offense punishable by a fine of not less than $100 or more than $200 to carry another person on a motorcycle unless the other person is at least five years of age. The bill provides a defense to prosecution that the motorcycle was being operated in an emergency or for a law enforcement purpose, and it specifies that it is not an offense to carry on a motorcycle a person younger than five years of age who is seated in a sidecar attached to the motorcycle.

I have to little girls both 5 and under and this should be common sense! Too bad there has to be laws made for those without common sense and for those that do not use proper safety gear when taking out the little ones.
Its a shame that Big Brother has intruded into another aspect of our lives. History seems to indicate that once they foot is in the door you can expect more restrictive legislation in the future.
I agree with texray. More intrusion by big government. I cant wait till the next election...I hope they all get voted out!!
I find it shocking a 5 year old can be a passenger on a motorcycle considering if a child is 8 years old or younger and not 4" 9" they have to sit in a booster seat to be in a passenger vehicle. Seriously.
