In what has now become a very messy situation for Factor 5, there is a report claiming work on a new Star Wars: Rogue Squadron game was continuing in spite of the companies bankruptcy.
Factor 5 declared for bankruptcy in May of 2009. Employees were laid off late last year and as of November of last year, the company has failed to pay its employees.
The Marin Independent Journal spoke with the lawyer representing the employees:
"We allege in the suit that Factor 5 and its three founders fraudulently transferred assets, including source code and other intellectual property to Blue Harvest, which is now known as White Harvest," said James Smith, a San Francisco lawyer representing the employees. "We believe and have alleged in the complaint that Factor 5 and White Harvest are essentially the same company, being run by the same people, being represented by the same sets of lawyers, with all the same management and ownership and control, performing all the same work that they were doing at Factor 5, just now with a new name and a new address," Smith said. Before the bankruptcy was declared, the source code was moved to another company for safe keeping by the executives at Factor 5 with the hope of evading further debt. While a new Rogue Squadron game sounds very appealing, it may be a good idea for the company and the employees to reach some sort of settlement before development resumes so to prevent any bad-blood from becoming a stain on the game itself.
