In December, Governor Jim Doyle signed a law that requires breeders who sell more than 25 animals a year to be licensed. There are additional requirements of appropriate space, food, shelter and exercise. The Associate press reports that the no-kill shelter in Marathon, WI has been overloaded with dogs turned over to them because of the new law. They've taken in 25 dogs compared to their capacity for only about 12.

There is some confusion however, since the Wisconsin Department of Agriculture website (HERE) states the law goes into effect, June of 2011. There is no explanation as to why breeders or supposed puppy mills would be abandoning dogs a year early. Emailed questions to the Dept. of Agriculture and the shelter in Marathon, New Life Pet Adoption Center, have yet to be answered.

The explanation of the law goes on to say that the sale of 25 animals a year also must come from at least 3 litters before the breeder falls into requirement zone.  The law is called Act 90.

Act 90's purpose is to protect dogs and consumers who purchase them. Requirements call for inspections of facilities at least once every two years. Those who get licensed by the end of the opening month of this law in 2011 may be able to obtain temporary license without inspection.

In addition, sale of dogs has it's own requirements. Dogs must be at least 7 weeks of age, examined by a veterinarian, have vaccination records and statement of health from the vet.  Dogs sold at auction must have proof of testing negative for brucellosis or be spayed or neutered.

In the next year, if the report from Marathon is any indication, this will test the mettle of breeders across the state. Shelters will want to be prepared however, for the falling out of the puppy mills who can't or won't comply with the new law.

    Buying a puppy without problems is harder than most people think. Finding a responsible and knowledgeable breeder is very difficult.
