Medical Marijuana has been a hot and controversial topic in Rhode Island. Now a man licensed to grow medical marijuana is in trouble with the law for allegedly growing too many plants.
According to press release State Police arrested 65 year old Louis Magiera of Scituate after discovering 20 marijuana plants at his home, by state law licensed medical marijuana growers are only allowed to possess 12 plants.
WPRI reports ," Magiera has been under investigation by the State Police High Intensity Drug Trafficking Area Task Force since June of 2009, after investigators were tipped off that Magiera was involved in a marijuana distribution ring.State privacy policies did not allow the Health Department to tell investigators that Magiera was licensed to grown marijuana."
A press release issued Friday by State Police Captain David Neill says that policy should be changed: "This investigation is just another example of why law enforcement should be granted the right to obtain medical marijuana patient or caregiver information. The inability to obtain medical marijuana patient or caregiver information from the Department of Health poses a variety of concerns to members of law enforcement. These concerns range from effective time/case management, to the safety and well being of the general public, medical marijuana patients, caregivers, and law enforcement."
