GF label law will make level playing field

Truth in labeling will prevent your brand from bad publicity, damages, and possibly even brand extinction. In order to protect consumers, the Food Allergen Labeling and Consumer Protection Act  of 2004 (FALCPA) was passed to protect those who are afflicted by the genetic autoimmune disorder, celiac disease with the requirement to list specific ingredients and other high allergen triggers.

The act contains two phases. The first phase was implemented in 2006 and called for the specific contents to be labeled clearly with a notice of allergens on the label as well. For those who need to avoid gluten, the second phase will be very helpful but the FDA has yet to implement that phase as they delayed their decision that was due in August 2008.

According to a study by Gluten Free Living Magazine, nearly 70% of all specialty food manufacturers that responded said that gluten-free foods will be safer but they will also be more costly once all food companies are required to meet the same standard for labeling. Due to the 20 parts per million maximum gluten content, companies will have to test their products to verify that they mee tthe new requirement. The cost of testing will likely increase the overall cost to the consumer.

When asked about consequences of the new law, 44% of respondents said they fear legal action while 12% said they will have difficulty staing in business in comparison to 38% saying that they think there will be a larger market for GF products and 75% reported that competition will be on an even level.

Bring it home: Never make false claims in your advertising and labeling. Follow all proper guidelines to avoid any consequences.
